The reality that the writer was addressing:

As you know, the risk that oral contraception will prevent implantation of an embryo is purely theoretical. There is no documented case of such a tragedy, since we have no way to verify conception inside a woman's body prior to implantation without causing the embryo's death. Even theoretically, the risk is vanishingly small, since the primary effect of oral contraception is to prevent ovulation, and the secondary effect is to prevent fertilization. To classify oral contraception as abortifacient, one would have to posit a scenario in which the drug fails to block ovulation, then fails to block fertilization, and yet somehow, having proved impotent at every other task, manages to prevent implantation.


-- and the fact that despite these FACTS, there is a war being waged against women who need contraception / emergency contraception on the ground that it kills little tiny human beings.

The rest of it was just wickedly, brilliantly funny.

The letter is clearly intended to point out the ridiculousness of the proposed rule. Saletan concludes: “As research uncovers additional causes of miscarriage or preimplantation embryo loss, I look forward to further legislation against caffeine consumption, exercise, and other abortifacient activities among premenopausal women.”

Well, William, to be consistent with the HHS proposal, you wouldn’t need to make the things themselves illegal - you’d only have to legislate that nobody has to let women do anything. ever. that could hypothetically harm a fertilized egg. Women of childbearing age don’t need to buy cars, go to work, eat food, or leave the house, do they? Because it would be discrimination against people who sell cars, offer jobs, sell food, etc. to make them let women do those things.


And that's just exactly the point.

Even just sticking with pharmaceuticals -- how could my pharmacist ever be forced to fill my hypertension prescription (hypertension being a possible threat to my life, of course), knowing that I might become pregnant at some time while taking it ...
