If ADA is ruled
not to be constitutional after bush's appointees to the courts are in, are there any states where discrmination against the disabled is outlawed besides the ones that site ADA and will their laws hold up under the states rights sway or will these judges just rule they can be discriminated against even with states right? Anyone researched this situation yet?

2. ADA
I doubt it will be found unconstitutional. Over the years, it's been so whittled down that it's meaningless. Washington state has a strong statute against disability discrimination. It's a part of the regular discrimination law, RCW 49.60. This statute would survive despite a repeal of ADA.

3. That's good to know
since many state's mention ADA in their laws (if they have disability law written in statute) which means if it is ruled that congress overstepped its bounds with ADA, the basis for the state law would be gone.

5. Don't know about other states
Off the top of my head, I've seen cases arising out of state disability discrimination laws in Colorado, Michigan. I'd check those states first. Then, I'd check the statutes of the more progressive states, NY, California, NJ, Connecticut.
