Anyone on SSI know about transfering to CA
from out of state?
Is it hard to get the $308 supplimental SSI if you move there.
How about if you live in a 17' sailboat on a trailer?
and are moving around the state with only a PO box?

1. Sail boat? POBox? I'm not sure..
Wiley, I would suggest you contact your local Social Security office OR go online to their website where you can look at the info; possibly get some feedback from that too.

Human beings are allowed to move/relocate around the country, I'm just not sure if their is a penalty waiting time for benefits from the state you move to or what.

A person may have to live in the state for a certain period of time before that state's FULL benefit package/transfer from another state kicks in for them. If one is already getting disability benefits from another state, I'm sure you can draw on it whereever you are up to 30 days....maybe more if they don't know you've left. (ahem) For the most part, people drawing SSI aren't suppose to keep moving around--like a transient. SSDI is different. SSDI is money one paid into via ss taxes. Someone receiving those benefits can travel to europe and go all sorts of places without penalty--although even then one HAS to have a permanent place of residence so they can find you when they need to reevaluate or change your benefits package. ((SSI likes to keep tabs on people too; for re evaluation purposes and it's much stricter.))

In terms of a P.O.Box; it is my understanding that a person cannot draw benefits in a particular state unless they have a permanent residence...a solid street address--NO p.o.boxes. It does not matter what that address is--like a docked sailboat--just so long as it's permanent; not a motor home or auto that one keeps moving around in etc. "Homeless" persons here use "The Shelter" for their permanent address. Also, it is BEST if one has a direct deposit into a bank for their checks. That way where ever you go, you can draw on that money...even if you're just on vacation for example.

This info is only general. It's best if you just talk to a worker at the Social Security office in your town or go online.

Best of luck..

2. For The Record: I don't own the sailboat
It's being loaned to me 'cause it's the only shelter that I can come up with.
I really do respect your input. At least you responded..
My problem with asking anything of SS is that every time I've gone to them asking for annything, they have used whatever info I give them in the process to screw me more.
I am relying on what I can find at
http://www.ssa.gov/OP_Home/cfr20/416/416-0000.htm
and my legal rep who really feels like her responsibility is over with the decision by the ALJ.
The only thing that I have to get her to do anything else is that since she gets %25 of my arrearage and that means %25 of $1200 ( what they admitted they owe me and has been quickly spent) that she's only gonna get $300 for 3 years work on this case. That's why I'm asking for advise here.
Tn is rated number 50 in a list of the best states to get disability. I had to wait in line 1 and one half years just for a hearing ( They turn down everyone for as long, as they can drag it out) and guess what: I got an ALJ who could read my medical records and granted it with no hearing the same day it hit his desk.
I really haven't found anywhere to land at the moment. I don't know a soul in CA. That's why the PO box..

4. I truely am sorry you are having such a difficult time with SS..they
do it on purpose. The goal is to NOT give out any benefits if they can at all keep from doing so. However, there are clauses and sections of the code that I found helpful in determining what I was going to say and/or apply for BEFORE I filled out the paper work or went to see them.

You might try accessing the particular state's (the one you wish to move to) SS headquarters to see what they say about transfering.

In any case, I'm pretty sure a person has to have a permanent address to start receiving benefits from here--California.

A tip may be to make a visit while on TN SSI, find a place to set up an address--even if you are sharing a house with someone else; that would constitute a "permanent" address--OR just look around for awhile until you can find out what the deal is for you here.

You have to remember, though, that Calif is EXPENSIVE!! Depending on what area you land in (and this is an enormous state), the rent, space rent, docking fees etc can be fairly reasonable or OUT OF THIS WORLD. Places in Upper Northern Calif. are much more reasonable (by comparison) but it's HOTTER THAN DICKS HATBAND... 115 degrees in summer; a little cooler in the mountainous regions. Very dry. Lots of rivers and lakes. Smaller towns; easy going.

I just saw a news article on the town of Arcata. That is on the coast at the extreme northern part of the state (cold and foggy, former logging fishing type community). Arcata apparently has quite a few activists who are against Corporate non sense et al. Little towns like that might have Peace and Freedom centers or such like that that a newbie could hook up with in order to get help with housing etc...

California gives more in benefits than most other states. We too have to jump through hoops. Many people have had to use a lawyer to help them while others with serious problems have been accepted right away. Of course the national Social Security and Disability program IS tinkering/cutting away at the former rules as to who gets what and when and sending out those edicts to all the states. Who knows, my SSI/SSDI might be cut off if Bushco keeps getting his way. It's a crap shoot my friend.

Good luck, SB

3. Kinda in a bind here ( reposted from CA Forum)
Yes, I know about SSA.gov. It took four years for my claim to reach an Administrative Law Judge. When it did, he didn't even bother to schedule a hearing because ( unlike everyone at SS and DDS) he could read my medical records.
I've almost memorized 20 RSC Part 416 of the SS rules (red book) over the last few years. Unfortunately, they are ignoring their own rulebook and stalling ( the waiting list in TN for getting a hearing before an ALJ is currently over 18 months ) I'm sure that most of us who frequent this forum know this story by now.
Don't know what to do and have a week to come up with a plan. I've been staying with my 81 yo mother during all this. She suffers from dementia and on Tuesday was told that she has cancer and less than one year to live.
Her Church of Christ ( who hate me as an atheist) and my ultra right wing repub sister ( who hates me for obvious reasons), both of whom my mother is completely dependent upon for support; are taking this opportunity to have me evicted. Sis has hired a lawyer here from FL where she lives to begin proceedings. Trying to reason with them are futile.
My only logical refuge is my son who lives in Walla Walla, WA. But, having graduated from college with a double major just last week and sharing a house with three other students; can offer me no refuge.
If SS was playing by the rulebook, they owe me $18000 and I had planned to use that money to relocate. Now they are fighting me over the amount. They say the owe me no arrearage (back pay) and will give me only $200 a month instead of the $579 I should be receiving.
So you see I'm in crisis and grasping at straws.

5. Get a lawyer
I'm sorry you're having such an impossible time, but if Soc. Sec. is trying to cheat you out of $18K that you are owed, then it is time to get a lawyer who specializes in Soc. Sec. Yes, they'll likely want 10% of what you are awarded, but losing only $1,800 as opposed to $18,000 seems like a no brainer. Lawyers who specialize in Soc. Sec. cases do not generally need to be paid up front.

From your post, I'm confused as to whether you live in FL or TN but you should also defintely contact your Senate and House members. Usually they will have someone on their staff who specializes in Soc. Sec.

Finally, if your local office is giving you the run around you have the right to have the office handling your case transferred ANYWHERE. Last year I helped a 73 year old gentleman who suddenly had his SSI benefits cut (he had been self-employed his whole life so no Soc. Sec. retirement benefits) in half. There was no reason given for this, and the person who headed up his home office was being a total arse. Just calling another district and getting his case transferred there got rid of the roadblock and we were able to get his full benefits restored within 3 months and a check for the back money owed was issued within six.

I wish you all the best.

6. ALL THANKS TO SALVORHARDIN!!!
Edited on Tue Jun-14-05 01:15 PM by Wiley50
Thanks to the above posters advice, Today I transferred my case back to the original SSA office that I filed it in. The SSA office that my lawyer has had a good working relationship with for years and where she can help me with it.
The SSA office here had had me assigned to a renegade case worker ( and her supervisor) who are making up rules not in The Red Book ( 20 RSC Part 416) in order to deny me the benefits that the judge awarded me in my fully favorable decision dated 2/25/05.
All Hail Salvorhardin!
