I have a question re SSDI
my court date was 9-13-06, today I received a notice that their decision was fully favorable, and that I have been disabled since 10-01-01. I filed on 2-25-04. what am I to expect now?

1. Hmmm.
Typically, I thought any claim for disability only runs from the date of application, regardless of how long you've actually been disabled. It seems from what you say, however, that the court has ruled that your entitlement runs from 2001, so I'm guessing that means SS will have to pay out, backdated to then.

2. hubby is on SSDI and
you get be paid retroactive back to the date YOU FILED not the date you were hurt. You will get your back money hubby got his in one lump sum but I have heard that they have been paying in payments so this is something you may want to ask your attorney.

6. the attorney who represented me
had never even talked face to face with me. I felt like an observer, not a participant at the trial. Do you know how long after the trial your husband was compensated?

that's what happened with me. From the date I filed I was paid retroactively. Of course I had NOTHING to live on up to that point so by the time I paid everyone back the money I borrowed from them I was about even. When you reach retirement age (they keep raising it, who knows when it will be by the time you reach retirement age?) it segues right into retirement benefits. It's transparent.

I never even had a hearing for my claim. Of course, I'm unable to do anything I used to do but you have to find other ways to occupy your mind. Railing against the Bush Administration is my occupation now. ;)

22. hubby cant do anything he used to do
although he does try but pays dearly for days after. He has an infusion pump (morphine) for back pain and is growing old quickly unfortunately. Im not sure how I feel about the pumps, they have their good and bad points. But the one thing I know I have to do now is put a burn proof floor under where he sits because he is constantly falling asleep (in the middle of a conversation even) and dropping his cigarettes.

23. They wanted me to have one of those installed too........
I told them, NO WAY! There's a couple pounds of titanium in my back right now that didn't do any damned good. They're not putting anything else in there. They give me Methadone and Soma. It keeps the pain bearable, most of the time, but I've aged terribly in the last 5 years as well. It sucks. Chronic pain blows. I can commiserate with your Hubby, sounds like we're about in the same boat.

24. sure sounds like it....
he was on morphine pills until they put this thing in he has two more years until they have to do surgery again to replace the pump (battery change and they replace the whole unit) and he is really considering just taking the pills.

You should get retroactive benefits dating back to 10/01/2001. Congratulations!

On Edit: I hope it's retroactive to 2001, not just when you filed. Judging from previous post, I could be wrong. :(

8. hubby won his in nov 99 and
got his money in jan 2000, then SSDI are sent on wednesdays and which wednesday of the month depends on the last 2 numbers of you SS#

10. seems to me i remember them
social security telling hubby it was the last 2 digits of his SS# but hey I maybe wrong there but his pay date doesnt seem to fit his birthday.

Born day 1 through 10, second Wednesday of the month; 11 through 20, third Wednesday of the month; 21 through 31, fourth Wednesday of the month.

18. we are ok
but paying for medicare sucks since it hardly pays for anything. Im in school and worked outside the home otherwise we would never make it. Im glad we have it but it is a definate change after working for more than 25 yrs of his life and two tours in Nam. You make alot of living adjustments that is for sure. I dont know if you were hurt at work like he was but when you go to less than half of your monthly income its a shock to the system.

your're eligible for Medicare now too. I don't know what your health insurance situation is, but you can be covered by Medicare Part I and II plus the fantastic prescription drug benefits. (forgot the :sarcasm: emoticon ;) )There's a Humana plan that's not too bad and only costs about $8 a month. Check it out. You paid into it all these years, you may as well reap the benefits.

25. I can't remember.
I was on SSDI for a while quite some years ago and I recall I had to run out my SDI before I could even apply, then survive until it was approved.

The retroactive check was substantial -- but now I can't remember how long it took to get it, or whether it was retroactive to the start of my disability or simply the date I filed. I do seem to remember that I got it within a few weeks of the final approval, though.

So sorry. I wish I could remember the details.

Hopefully, you'll get yours soon and it will make up for everything you had to go through to get it.

31. It took me a month or two to get my back pay.
Put most of it in savings, but keep a bit out for fun and things you need, but been denied.

I paid off my mortgage with my savings and investments, then put the back pay in savings. I did leave a bit out for fun. ($100.)Fun is good medicine.

You will get a good payday. Be wise with the windfall.

7. Social Security Disability is retro for up to 12 months
from the date you file. If you filed 2-25-04, you can be paid back to February '03, provided the judge agrees you became disabled then. SSI, a different disability program administered by Social Security, is paid back to the first day of the month after the month of filing.

27. I think the answer has already been posted
But you can get Social Security Disability Benefits back to 1 year before you applied, assuming you are found disabled as of a date at least 17 months before you applied. The 17 months is because there is a 5 month waiting period. So from what you described, if the ALJ found you disabled as of 10-1-01, you should get more than 3 1/2 years back benefits (less any attorney's fees). I don't remember off the top of my head if they will start 2/1/03 or 3/1/03--I think 3/1, but I'm not sure. Congratulations.

It takes a month or 2 before the benefits actually start coming. The benefits are not usually paid in one lump sum, but in a few periodic payments. I can look that up for you if you want.

Just a warning, if you don't have a long work history (5 out of the 10 years preceding 10/01/01) you would be eligible under the Supplemental Security Income program. This program does not go retroactive, so you would have a year's less benefits.

28. They would start 2-03 for Social Security dib.
February 04 is his protected filing date; 12 months retro would make a date of entitlement of 2-03.

I am 58 years old and have worked since I was 15. Do you know about compensation for my three kids?
I am so blown away by this news I can't tell you! I want to tell the kids, but I don't want to falsely give them hope.

30. How old are the kids?
If they are under 19 and still in high school, they will probably get dependent's benefits. There is a total amount of benefits that dependents can get. I think it is about half of the amount that you get, but social security should be able to tell you the amount -- even if they don't have the decision from the judge yet, it's a simple math calculation. That total family amount is then divided among the eligible family members. So as one of your children becomes ineligible, the amount the other children get is increased. Also, the children get back benefits too. If you have eligible children that you pay child support for, in many states, the SS benefits the children get will offset or count as child support you pay. But that may be dependent on the state you are from.
