Ariz. official: Ruling on base act is relief

PHOENIX — A Maricopa County official says the county will enforce a state law designed to protect military air bases from encroachment now that the law has been upheld in court.

Supervisor Max Wilson said a Superior Court judge’s ruling Tuesday is “a relief to all concerned” because it at least provides clarity regarding the issue.

The ruling came on litigation over the county’s refusal to enact certain land-use restrictions for areas around Luke Air Force and two auxiliary fields.

Wilson says “we now have a clear direction on the issue and we’ll move forward.”

Judge Edward Burke granted the state a preliminary injunction but he also suggested that the state might have to reimburse the county if a property successfully sues later for damages.
