An Army Reserve lieutenant colonel has filed suit against the investment company that manages the Thrift Savings Plan for service members and federal employees, alleging that his rights were violated when he was demoted upon returning from a deployment to Afghanistan.
Lt. Col. Timothy Kohn alleges Barclays Global Investors violated his rights under the Uniformed Services Employment and Reemployment Rights Act when he came back from Afghanistan in February 2008.
The lawsuit is filed in U.S. District Court for the Northern District of California, based in San Francisco.
After Kohn complained about the demotion, he said he was given a written warning and a performance improvement plan.
“It is simply disgraceful that a company that profits from managing our troops’ money would disregard their obligations under federal law,” Kohn’s attorney, Angela Alioto, said in a statement.
