Marinette withdraws patrol boat protest

Marinette Marine Corp. withdrew its second protest of the Coast Guard’s decision to award the Sentinel-class patrol boat contract to rival contractor Bollinger Shipyard, just a few days after a judge denied the company’s request for a temporary restraining order and injunction that would have once again halted production of the fast response cutters.

Marinette Vice President and General Manager Richard McCreary said the company no longer believed it “had a reasonable standard of success in the case,” after a judge denied the request for a temporary restraining order.

The company notified the Justice Department of its intent to file the post award protest in the U.S. Court of Federal Claims on Feb. 9. Three days later a hearing was held and the request was denied, McCreary said.

The decision follows a Jan. 12 Government Accountability Office decision denying Marinette’s original protest claiming the Coast Guard’s award to Bollinger was “unreasonable.” Work on the FRCs had been put on hold in October while GAO reviewed Marinette’s original protest.

There are three significant differences between the Bollinger and Marinette proposals, each of which were protested by Marinette, according to the GAO report:
