Roe v. Wade as a Radical Republican Trojan Horse
It is a mistake for Democrats to let Roe v. Wade be treated as their principal litmus test for Supreme Court nominees. It enables Bush to put onto the federal bench rightwingers who are going to use the Courts to advance the agendae of corporate power and its close cousin, negation of the Bill of Rights, by using the ploy of moderation on Roe v. Wade. Do not misunderstand me; I am not advocating Democratic retreat from support of the fundamental Constitutional rights of privacy and liberty of females of child-bearing capacity. What I am advocating is that the fundamental right to free choice regarding carrying a pregnancy to term cannot be the only story or the end of the story.

The preoccupation with abortion rights can lead Democratic Senators into the box of having to concede, "so-and-so is acceptable because he/she has satisfied us that he/she is unlikely to overturn Roe v. Wade," even though the nominee may be opposed to the decisions of the New Deal Court that gave Constitutional approval to economic regulation and the decisions of the Warren Court that began to fulfill previously neglected promises of the Bill of Rights. In effect, it opens the door for the Radical Republicans to use Roe v. Wade as a Trojan horse with which to catch the public unawares of their further expansion of corporate government.
