Posted here last Aug 2010 when court date set,
thought had agreement Nov 1 pursuant to ADR, he refused to sign our draft of agreement, has played games since, so new judge + trial set for tomorrow, March 15, 2011!

Took him until March 9, when trial set for March 15, to send draft Consent Order, which I amended Friday March 11, + this afternoon he comes back fighting about 'facts!'

SO MAD! Will ask new judge for changed/increased alimony, so I can live decently until agreement or trial, whenever those might occur.

OMG!

1. Hang in there.
What I am really furious about in the system, because it happened to me, is that either side is allowed to delay and delay and delay. I can tell you that when I was an airline employee, lawyers were among the pissiest about flight delays. Hey, at least we don't delay them for months at a time.

2. 'husb' representing himself,
+ tho was generally OK before the judge, husb, my attorney + I got into it in lobby. May have said before he's sociopath, and that showed thru clearly. We're actually close on the merits, but he'll do whatever he can to delay and aggravate.

So have to go back to ADR, which is OK w me, but after last ADR, Nov 1, he balked at my atty's draft of agreement we had arrived at, and never informed us of his complaints/differences with it. This is a power play.

Thanks

3. You might want to talk to your attorney about holding
him in contempt of court if he doesn't start responding in a timely manner. For the most part judges are on to this crap.

4. Mentioned the historical timeline today, briefly, to judge,
but he's new to the case and wants to move it smoothly/without rancor; ok w me if it works. Will surely do so if that crap occurs again.

Thanks again, still, SheilaT!

:hi:

5. Has anything new happened?
Even though you don't want to piss off a judge, you and/or your attorney need to bring him up to speed about your soon to be ex-husband's past behavior.

7. Sorry for delay, SheilaT, and thanks as ever for your thoughts.
Nothing new, and trying to serve him with Motion for increased alimony. Will file Praecipe of what's been going on with judge, including info about 'husb's' statement to ADR atty that 'we don't need you,' in spite of fact judge told us he'd like us to proceed that way.

8. You really need a judge who is on your side
and will slap husband with a serious Contempt of Court.

My ex was simply a little bit late with support money and they filed the paperwork on him. Hasn't happened since.
