Rove testifying before CIA leak grand jury
Top White House aide Karl Rove prepared to testify Wednesday for a fifth time before the federal grand jury investigating the leak of a CIA officer’s identity, a person familiar with the case told NBC News.

Rove consulted with his private lawyers before a scheduled afternoon court appearance and was prepared to answer questions about evidence that emerged since his last grand jury appearance last fall, the person said, speaking only on condition of anonymity because of grand jury secrecy rules.

That new evidence includes information that emerged late last year that Rove’s attorney, Robert Luskin, had conversations with Time magazine reporter Viveca Novak during a critical time in the case.

If he's trying to "clear something up", he's almost certainly digging a deeper hole with Fitz. I think this is probably good news.

15. Sure - if the jury has questions, they're well within their rights
to have Fitzgerald call back a witness for further questioning.

I'd say Fitzgerald has presented his case and now the jury has some questions.

19. If Rove is meeting with Fitzgerald he is either copping a plea
or he is answering a few more questions that Fitzgerald wants cleared up before asking for an indictment.

Most likely this is a precursor to a plea bargain.

For a plea bargain there are a few scenarios:

1.) Plea the charge down to a lesser charge in order to avoid a trial or a felony charge. Usually this includes cooperation against any other targets (Libby, possibly others)

2.) Plead down the sentencing recommendation again including cooperation against any other targets

As for answering additional questions, this could be a last ditch effort to allow Rove to rescind previous testimony that would require Fitzgerald to bring a perjury indictment. This is dangerous territory for Rove, since if he admits he lied in an attempt to get away from the perjury indictment, he opens himself up to a charge of Obstruction of Justice and also doesn't guarantee that Fitzgerald won't charge him with perjury anyway.

The final possibility is that this is a last ditch effort by Rove to head off charges altogether with an offer to testify. Usually this would require a "bigger fish" It doesn't get much higher level than Rove and Fitzgerald knows this, so the only logical higher up targets would be cabinet members or the VP or the POTUS.

I'm guessing we'll see Rove plead down to a misdemeanor in exchange for testimony against Libby.

idiots... how about covering what she was working on or that we are using a terrorist organization inside Iran to commit acts of violence... i am so fed up. This is why I stopped covering Rove going in and out of court, because it eats up from the serious issues. until there is something to write about with regard to Rove, that is to say, like when he sold out Cheney on those emails, going in and out of court and everyone speculating as to why takes away from the much needed attention to a coming catasrophe: IRAN.:(

I throw my hands up, going to nap and will write another story on Iran that will die a fast death and be reported months later by some idiot as an "exclusive"
