Question
An idea I've been kicking around in my head, of framing this need to break privacy laws to fight terrorism...Does this mean that the right wing is saying that our form of government doesn't work, since we have to take away our rights (guaranteed by the Bill of Rights)? Is that what they are saying? Maybe if we frame it like that, it might work?

3. They Say It's Constitutional
because the constitution has loopholes for suspending certain liberties in times of war.

For example, Article I, Section 9 states
The privilege of the writ of habeas corpus shall not be suspended, unless when in cases of rebellion orinvasion the public safety may require it.

So, the Republicans consider 9-11 an "invasion" giving them the U.S. government the right to detain people without any legal proceedings.
