Why am I not surprised?

I thought that the rights of the states to decide on these things for themselves was protected by the Constitution.

BTW, check out the Nevada initiative at www.regulatemarijuana.com because they need all the attention they can get.

1. The Civil War modified the whole state's rights thing just a little.
Just a wee bit..

2. Au contraire
The Feds have been in open revolt against California's medical marijuana law since it was passed by the voters a few years ago.

Under the Commerce Clause, the Feds can and do legislate in the area of drug control. They've asserted that their statutes pre-empt California statutes -- I don't know where that is in the courts, but the Bush Administration is WAY out trying to prevent California cancer patients from receiving marijuana.

Reefer madness, you know. Those cancer patients are liable to rise up and . . . eat too much with the Munchies?

3. Let's get real
The only people who would deny cancer patients the comforts of pot are sadistic creeps.

And sadistic creeps tend to vote Republican.

4. I know the argument
if you read the text of Nevada's law, it actually preempts that argument (at least by my read).

The point remains, federal law enforcement has no business in state elections... let the state do its thing and then try a case out in court.

5. Such was the argument of George Wallace
Really, the only proper standard in these situations is kindness.

Simple kindness to another human being.

This is a moral issue.

It is immoral to deny the sick and/or dying that which eases their pain.

My dad died of cancer of the colon. It invaded his lungs. Towards the end, he asked me to get him some pot. Do you think I denied him merely because the act was illegal?

7. W also interfered in Oregon's right to die laws
It's basically a moralistic fundie thing. W is (now) against drugs and aligns himself with the extreme right wing fundies on the right to die.

He's only for states rights when it doesn't violate his fundie backers beliefs.
