Moral Authority and Legal Certainty.


Mister Bush,

The United States Of America has one law. The moral authority of USA comes from its absolute rule of law. It is not only obscene but absurd that your administration is trying to govern under the policy, “Here is the law, how do we get around it.”

How dare you try to play the ‘legal certainty’ nonsense game to get around doing the right thing with regards to treating accused people held in US prisons? Can you seriously be suggesting USA ignore international laws, agreements and treaties?

When the following happens, what will your response be?

A US service member will be captured by an enemy state and held as a prisoner. This person will be subjected to the same level of treatment that USA gives, even torture. The service member will be subjected to trial where the government will not allow him/her to see all the ‘secret’ evidence against him/her. The enemy state will say Article III of the Geneva Convention lacks legal certainty, is vague and does not apply to the captured US service member.

Enemies in the past have acted with restraint toward US prisoners of war (POW). Nazi Germany, North Korea and North Viet Nam had certainty that USA would not allow legal mistreatment of POW because the Geneva Convention protected service members.

Your actions put this at risk. Where are you going to stand? What will be USA be able to do or say, when the service member is subjected to secret trial, tried, convicted and executed by an enemy state?

You are a master at gaming the domestic system. You love to pay lip service to “core values” and integrity, all the while lying, cheating and stealing to advance your policies of greed, graft and grief. This may have helped you to seize power but not hold it.

Until and unless you learn to accept the principle of, “Here is the law - follow it,” you are doomed to fail. Your failures have harmed the USA, threaten military service members and will continue to limit the ability for USA to lead the world.

USA is a land of laws. You need to get back to living within the law.

Civilized people have been able to defeat organize crime, capture their criminal leaders and bring them to justice using the law, national and international. Use the law to your advantage. When the law needs it change it, don't try to go around it.
