State sues over campaign calls

Attorney General Steve Carter has filed a lawsuit today in Brown County Circuit Court against a group making automated phone calls targeting Democratic congressional candidate Baron Hill. Carter also is seeking a preliminary injunction against the California-based group, Economic Freedom Fund, which is financed by Bob J. Perry, a Texas homebuilder with close ties to White House adviser Karl Rove. Perry also bankrolled the Swift Boat attack ads against the war record of Democratic presidential nominee Sen. John Kerry in 2004.
Carter is holding a news conference at 2:15 p.m. today to discuss the legal action.

Carter, a Republican, began investigating the calls after receiving complaints about them from people who live in the 9th Congressional District in southeastern Indiana. Hill is running to represent the district, against Republican U.S. Rep. Mike Sorrel and Libertarian Eric Schonberg.

While political calls are exempt from Indiana's do-not-call law, they are not exempt from a 1988 law which bans prerecorded automated calls. A live person must first seek a person's permission before playing a recorded message.

1. I love getting automated prerecorded political messages
it's helps me know who NOT to vote for. The law doesn't REQUIRE them to consult the do not call list, but they could if they wanted to. Nothing stopping them from being respectful enough not to call people who already said they don't want to be called.

2. Good for Carter pursuing this...and he is a Republican....
The individuals that are being targeted need to sue also for defamation and whatever else they can....the problem is the Swiftboaters have not been challanged....

3. I agree. Is there ANY Democrat who has the intestinal
fortitude to sue any of these fascists? Clinton complained about the ABC 911 movie, then to my knowledge forgot about it after it was aired. Kerry promised to fight personal attacks then shrunk to a dark corner when the swiftboats came after him.

Until the Democrats start fighting back and recognizing this is a true ideological war, they are doomed to lose.

5. Goldilocks that will be the question that historians will ask
when they look at this sordid time in American History.....they will ask why the Dems and or any other individuals did not sue, did not put uup a real fight against these facist bastards..

7. Backer of Swift Boat ads funds group targeting Hill
BLOOMINGTON, Ind. - A group being behind automated phone calls attacking Democratic congressional candidate Baron Hill is being funded by the Republican donor who helped bankroll the Swift Boat attacks on Democratic Sen. John Kerry's war record.

Bob J. Perry, a Texas homebuilder with close ties to White House adviser Karl Rove and former House Majority Leader Tom DeLay, recently donated $5 million to the Economic Freedom Fund, a newly created California group targeting Democratic candidates.

Among those candidates is Hill, who is seeking to regain the congressional seat he lost two years ago to Republican U.S. Rep. Mike Sodrel in southwestern Indiana's 9th District.

Indiana Attorney General Steve Carter is investigating the automated calls, which are illegal in Indiana unless the recipient agrees in advance to accept them.

Agency spokeswoman Staci Schneider said seven people have filed complaints about automated calls, at least four of which were about Economic Freedom Fund calls. The law against automated calls provides for civil penalties of up to $5,000 per violation.
