ACLU Condemns House Panel's Passage of "Public Expression of Religion Act," Calls Bill A Direct Attack on Freedom of Religion (9/7/2006)

WASHINGTON — The American Civil Liberties Union today expressed its dismay as the House Judiciary Committee approved H.R. 2679, the "Public Expression of Religion Act of 2005" (PERA). The bill would bar the recovery of attorneys' fees to those who win lawsuits asserting their fundamental constitutional and civil rights in cases brought under the Establishment Clause of the First Amendment.

"If PERA were to pass, Congress would isolate and discourage enforcement of a specific piece of our Bill of Rights," said Caroline Fredrickson, Director of the ACLU Washington Legislative Office. "PERA advocates are seriously misguided in their claim of defending religious freedom. This legislation would in fact weaken the very freedom they claim to be protecting. We are deeply disappointed in the committee's decision to allow PERA to come to a vote."

The ACLU said the ability to recover attorneys' fees in civil rights and constitutional cases, including Establishment Clause cases, is necessary to help protect the religious freedom of all Americans and to keep religion government-free. People who successfully prove the government has violated their constitutional rights would, under the bill, be required to pay their own legal fees -- often totaling tens, if not hundreds of thousands of dollars. Few citizens can afford to do so. But more importantly, citizens should not be required to do so where the court finds that the government has violated their rights and engaged in unconstitutional behavior.

The elimination of attorneys' fees would also deter attorneys from taking cases in which the government has acted unconstitutionally. In many cases, religious minorities would be unable to obtain legal representation to defend them in instances when their religious freedom has been violated by the government. The bill would apply even to cases involving illegal religious coercion of public school children or blatant discrimination against particular religions.

that Republicans are famous for.

They don't care about other people as long as they get what they want.

I've been seeing more and more DUers embrace that attitude lately, too...

This is probably one of the more detailed definitions I've found, seems pretty much the same as the traits I consider the most right-wing.

Polar opposite of my politics. (Proud ACLU member)

What a lot of these sites miss is the prerequisite step of putting police and prosecution on a pedestal, like "Cops" and CourtTV. This is how the Left has inadvertently contributed to the cause of fascism.

The ACLU has defended both Limbaugh and Falwell and probably many others of their crowd in the past. Right wingers might be less than usually self-destructive if they could remember stuff like that.

I first learned about Gen. Butler when I read the book "The Corporation" over a year ago and I was astounded by his story so I changed my avatar and sig to subtley promote his memory. Butler was a great American original but nonetheless part of a long tradition of upstanding, truth-speaking military leaders that continues to this day, as you are, no-doubt, well aware. :hi:

Well how about that? Suddenly there's no possible argument to justify this bill. What it says, in essence, is that when our elected officials attempt to violate the Constitution, any citizen who succeeds in stopping them will be penalized for his trouble. Only a madman could call this fair.

10. Thank you.
Thanks to the ACLU we have the right to an attorney in a criminal trial and we can protest the war among other great cases. While I don't agree with every single case they take on, they still try to defend everyone's rights.

17. I can't wait to see Freepers' reaction when this goes against
their preverted style of Christianity. Can you imagine the head explosions over there if a Christian in a predominately Muslim commuity is discriminated against and can't sue because (s)he can't afford the attorneys fees?

When are they ever going to think ahead?

Islam is the fastest-growing religion in this country - soon the Christians will not be in the majority in several major towns and cities.
