What is the process of working this torture bill through the courts?

What is the process of working this torture bill through the courts?
The distinquished gentleman from West Virginia stated on the floor of the Senate, "Thank God for the Supreme Court". So I am wondering how this happens?

1. a REAL case has to make it to the scotus.
i posted this in another thread.

they just dont rule on the constitutionality of laws, they have to be challenged by a party that has been damaged.

how is anyone with no rights going to get this into a court?

Only someone that had been harmed can bring a case. So what was Senator Byrd talking about??

5. Any detainee w/a pending
habeas corpus case can challenge this law, because they've been damaged by its suspension of the writ.

but the group sitting on the bench now worries me.
