Why is the media using this pic of Foley

Could it be that they are attempting to lessen the appearance of the age difference between Foley and the Page?

I think the official photos are in the public domain (made at taxpayer expense), media would have to acquire rights for others. If Foley wasn't on the radar, media might have been grabbing the picture from a .gov website.
