Hal Turner

A radio talk-show entertainer whose earlier statements that he "may" have to assassinate members of Congress if the wrong people were elected Nov. 7 now has set a timetable for those killings.

In a statement on his website, Hal Turner noted that a newspaper has reported that a bill granting amnesty to illegal aliens is expected to be enacted in January, when the Democratic Party takes control of the U.S. Senate and House.

"ANY MEMBER OF CONGRESS WHO INTRODUCES, CO-SPONSORS OR VOTES IN FAVOR OF ANY SUCH AMNESTY WILL BE DECLARED A DOMESTIC ENEMY AND WILL BE CONSIDERED A LEGITIMATE TARGET FOR ASSASSINATION," Turner posted on his website.

the jails are loaded with people for "Terroristic threats" like "I'm gonna fuck you all up." Amd there was that nutcase who got busted for his website showing where you could shoot abortion doctors.

Must be something on the books about threatening or planning assassination an elected official but in a pinch, good ol' Treason would do.

56. Around here a viable and credible threat to kill someone
or assault them is a crime of itself. They call it "terroristic threatening" - it is from the Model Penal Code.

I've represented people accused of it. Usually it is large men who get angry -when you are a tall, big man, you have to watch your temper, because people will get scared when they wouldn't if a smaller person threatened them. There is often a domestic violence context.

If he is serious he is at least falling under that, and if he makes any actual overt moves toward it that would be an attempted/conspiracy on murder.

"(a) Whoever kills any individual who is a Member of Congress or a Member-of-Congress-elect, a member of the executive branch of the Government who is the head, or a person nominated to be head during the pendency of such nomination, of a department listed in section 101 of title 5 or the second ranking official in such department, the Director (or a person nominated to be Director during the pendency of such nomination) or Deputy Director of Central Intelligence, a major Presidential or Vice Presidential candidate (as defined in section 3056 of this title), or a Justice of the United States, as defined in section 451 of title 28, or a person nominated to be a Justice of the United States, during the pendency of such nomination, shall be punished as provided by sections 1111 and 1112 of this title.
(b) Whoever kidnaps any individual designated in subsection (a) of this section shall be punished
(1) by imprisonment for any term of years or for life, or
(2) by death or imprisonment for any term of years or for life, if death results to such individual.
(c) Whoever attempts to kill or kidnap any individual designated in subsection (a) of this section shall be punished by imprisonment for any term of years or for life.
(d) If two or more persons conspire to kill or kidnap any individual designated in subsection (a) of this section and one or more of such persons do any act to effect the object of the conspiracy, each shall be punished
(1) by imprisonment for any term of years or for life, or
(2) by death or imprisonment for any term of years or for life, if death results to such individual.
(e) Whoever assaults any person designated in subsection (a) of this section shall be fined under this title, or imprisoned not more than one year, or both; and if the assault involved the use of a dangerous weapon, or personal injury results, shall be fined under this title, or imprisoned not more than ten years, or both.
(f) If Federal investigative or prosecutive jurisdiction is asserted for a violation of this section, such assertion shall suspend the exercise of jurisdiction by a State or local authority, under any applicable State or local law, until Federal action is terminated.
(g) Violations of this section shall be investigated by the Federal Bureau of Investigation. Assistance may be requested from any Federal, State, or local agency, including the Army, Navy, and Air Force, any statute, rule, or regulation to the contrary notwithstanding.
(h) In a prosecution for an offense under this section the Government need not prove that the defendant knew that the victim of the offense was an individual protected by this section.
(i) There is extraterritorial jurisdiction over the conduct prohibited by this section. "

with the remark that he thought it could not be defended against mortar or rocket attacks and promised to cheer if "the fed’s get wiped out."

the ability to fire everyone when they take over, because only the absolute top jobs are appointed. So there are a lot of good FBI agents. Just look at the public integrity devision, they went after all the corrupt Republican Congressmen.

If I remember correctly, they have done investigations, and US Attorney's at the district level have successfully prosecuted, a number of white supremacist/anti-government terrorists.

The only thing that's different now is that it won't be publicized, because the top of the food chain gets to choose that usually.

We can't forget, the even during Watergate, the FBI was a source of hope for American, because Deep Throat was the second highest ranking FBI official. And he was even an appointment.
