A reader transcribed this exchange concerning habeas corpus from today's Senate Judiciary Committee hearings no official transcript yet:

Specter: Now wait a minute, wait a minute. The Constitution says you can't take it away except in the case of invasion or rebellion. Doesn't that mean you have the right of habeas corpus?

Gonzales: I meant by that comment that the Constitution doesn't say that every individual in the United States or every citizen has or is assured the right of habeas corpus. It doesn't say that. It simply says that the right of habeas corpus shall not be suspended.


Article I, Section 9:

The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.

Alberto Gonzales should not only be impeached for his willfully obtuse interpretations of the Constitution, he should be disbarred.

I can't figure out how he passed his Constitution Test in High School (in Illinois it was a requirement for graduation), much less the Texas Bar.

8. AG too clever for himself
The man is too clever for himself, I believe, and will get himself in deep trouble now that the Democrats can have real hearings and ask probing questions. It is quite clear that he chooses to interpret the Constitution unconstitutionally because he has been allowed to do that all this time. When challenged, it will become clear and his game will be up. I use the word "chooses" on purpose, because I would bet he does understand just how unconstitutional he is being. He just doesn't care, in fact, he probably revels in the way he has been able to get over on everyone, making up interpretations that allow his inept and thieving bosses to get away with whatever they want. Just like a mob boss has his lawyers to get him out of trouble, so runs our government right now, with all our appointed officials working hard to cover up or hide the illegal activities of the pretender in office. Please please let them be exposed and this nightmare come to an end!

Seems specific to me. I understand he has a problem w/ it though.

13. Well, you answered your own question there --
"the accused"

So if you just grab someone and throw him in Gitmo and DON'T ACCUSE THEM OF ANYTHING you're good to go. They have no right to habeas, and are accused of nothing, so therefore you can do anything you want with them. If you do it to a lot of people, you even avoid the "cruel and unusual punishment" thing, by being cruel, but not at all unusual.

And the repukes were insisting that the restriction on habeas applied only to foreign nationals and illegal combatants.

17. Funny! But don't you worry about
Rummy. It's only a matter of time before he gets his own radio talk show or shows up as a distinguished talking head on, as you say, Faux News. That place is over run with people who failed up. Dubya will probably land there at some point. Stumbling and bumbling his way through some rants with Hannity or O'Reilly. He'll be the performing monkey (who was the president!) for the attack dogs and the Faux viewers will be so impressed.
I almost (almost) feel sorry for the people who watch that wretched network.
