Isn't Suspending Habeus Corpus Declaring Martial Law?

Isn't Suspending Habeus Corpus Declaring Martial Law?

Article 1, Section 9 of the U.S. Constitution states, "The privilege of the Writ of Habeas Corpus shall not be suspended unless when in cases of rebellion or invasion the public safety may require it." In other words, you cannot hold an individual without a valid reason. Therefore, in suspending habeus corpus you are then claiming you don't need a reason to hold any person, which in essence to me is then a declaration of martial law as well.

Now I may be wrong, but I thought only Congress could suspend the writ of Habeus Corpus. Lincoln didn't do so without Congressional approval, so how the hell can Bush do it without Congressional approval and on what solid constitutional basis does this even stand now? Or does he actually have that approval in the form of the Military Commissions Act? And most certainly then if the Military Commissions Act just recently passed indeed takes away that writ of habeus corpus, was that bill not also a declaration of martial law? I think one of the first orders of business for this Congress MUST be to repeal the Military Commissions Act because it is a blatant attempt to circumvent the U.S. Constitution to have Congress declare martial law by suspending habeus corpus. Am I wrong?

So why are they questioning Gonzales when they need to be working to restore our Constitution? Isn't it already a fact by his own words that Gonzales and the entire lot of them are enemies to this Constitution who must be impeached? What good is questionng those you give that authority to by your own inaction doing for this country if that is always as far as you go?

Habeus Corpus! :sarcasm:

Who doesn't think Gonzo and Yoo wouldn't try to get some fundy judge to read the Constitution that way?

American Idol is on and hey, isn't it tuna thursday? What's this obsession with rights anyway? We are safe. I haven't seen one, not ONE Iraqi in my street.

I thought it was Kraft Macaroni and Cheese night. And of course you haven't seen one Iraqi on your street... they're fighting them over there so they don't have to fight them here, even though they are also fighting the Americans here so they don't have to ... oh, forget it.

These pricks care nada about the constitution. They are thieving capitalists bent on making, America, a fascist state. Under martial law. The people are nusences to appease long enough to do their dirty work.
They want all the Pentagone budget, social securty funds, and congressional gifts to achieve their evil purposes. Robbing us blind and subverting the constitution so they can do it. Didcha hear how much Lockheed profitted from the contracts to make jets not only for the US but Briton, too. Lots money to be made beside the oil. We'll be out of Iraq when their government gives the western oil companies control of the oil fields. When that happens we need to oversee some geographical divisions and get the hell out.
