(1/19/07 - GREELEY, CO) - Dog poop. A "noxious substance" worthy of a misdemeanor charges or a form of free expression protected by the First Amendment?
A Colorado court will decide.

A package containing canine excrement arrived at the office of Congresswoman Marilyn Musgrave in May wrapped in one of the Colorado Republican's political mailers.

In court documents, attorneys for the retired French professor who sent it concede the gesture was "probably crude and boorish," but argue it was a form of political protest. They say the professor, Kathleen Ensz, was angry at receiving too many mailings from Musgrave.

The professor faces a misdemeanor charge of "use of a noxious substance." The case is scheduled for trial in May.
