Can Bill Clinton run for the office of POTUS in 2008?

In discussion right now and someone says he can't by law. I say he can.
Who is right?

The Twenty-second Amendment of the United States Constitution sets a term limit for the President of the United States, providing that "No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once." Prior to the adoption of the amendment, the constitution set no limit on the number of presidential terms. The United States Congress proposed the amendment on March 21, 1947. It was ratified by the requisite number of states on February 27, 1951.

and the President couldn't fulfill his/her term, could he become President?

I always assumed the answer was NO, that he was ineligible to run for VP.

But, in reading this, he cannot be "elected" to the post of President a third time.

Just curious.

There are other requirements that aren't in that link above. One that comes to mind is that the President and VP cannot be from the same State.

I don't think it's specifically stated anywhere that a former Pres cannot serve as VP, but since the principal reason for a VP is to take over the Presidency in the event the Pres cannot coninue serving makes me think a former 2 termer couldn't be a VP.

I think we need a constitution law expert to answer that one for sure.

Because he couldn't take over as Pres if something were to happen. It would have to pass to Speaker of the House. So no Pres candidate would ever pick him as VP.

Now, as far as I can tell, if you assume the job of President from Vice President, you aren't elected.

23. Actually...it is fairly certain he could not run as VP...

Constitution bars VP candidates who are constitutionally barred from the Presidency. Some believe there is a loophole in that a former President would not be barred from taking over the Presidency is say he were elected Speaker of the house, and the Pres and VP died. But the clear intention of the 22nd amendment was to limit a person to two elected terms in the WHite house. CUriosly, if a previously two term President were to become President again by the method above, he could not run for election on his own after that.

He can't even run for VP, since that office specifies someone who is qualified to run for the top slot.

The most anyone can serve as President is ten years, two years of a term he inherits through the office of VP plus 8 of his own. If he serves more than 2 years of somebody else's term, that's counted as a full term.
