Saddam and his co-defendants are being tried before what was originally called the Iraqi Special Tribunal, established in December 2003 by U.S.-led occupation authorities.

Generally a person can be tried for crimes against humanity or war crimes by his own government, or if his own government is unable or unwilling to do so, by the international criminal court at the Hague.

Although the Iraqi government is a puppet of the US, it is the Iraqi government, not the US, that is trying Saddam.
