Anti-abortion activists posts pictures of women entering clinic

An anti-abortion activist is posting Internet pictures of women entering an abortion clinic here.

Martin Wishnatsky, who is banned from going within 150 feet of the Red River Women's Clinic, said he usually stands on a street corner to take the photos.

"I have a little zoom lens," he said.

"I felt it would really give the average person who doesn't visit there a firsthand view of what it looks like to someone who is there," Wishnatsky said. "I hope this might contribute to turning people's hearts back to life."

Clinic Director Tammi Kromenaker called it an intimidation tactic.

Along with the photographs, Wishnatsky has posted the license plates of cars driven by people entering the clinic.

3. Here's how you stop him: You sue him for libel.

If he posts a picture of a women entering the clinic and claims she was getting an abortion when in fact she was simply there on other business (pharamceutical sales for example) - she sues the bastard to stop him from continuing this practice.

After that, he would no longer be allowed to claim that the women are getting abortions - they are just women entering the clinic - so the information becomes more ambiguous and hence, less "informative" to his intended audience. Not to mention - he would probably have to get a job to pay off the debt he owes to the person that sued him.

The other tactic is find a group of people that can stand in front of him and his camera. He has no more right to tell people to "get out of the way" than he does to take photos of those women. Fight fire with fire and video tape him during this disruption process and see if he gets violent: sue him if he attacks.

27. I don't have all the legal aspects but I do know this....

1) You need consent to publish pictures non-public figures, non-celebrities, etc... You see this on "real life" shows like COPS, etc... when they don't get consent they have to obfuscate the face. Celebs, politicians, or "those people in the public eye" can not use this to prevent publication of photos unless they fall into #2.

2) Due to the recent epidemic of kiddies using concealed video cameras to film "upskirt" shots and the like of unsuspecting women at the mall, there are "unauthorized photography" statues on the books in most states. Basically, they can be arrested for filming people in "private" moments without their consent. What can be more "private" than seeing your physician (be it for back pain or an abortion).

Now I don't know the specifics of either of these laws, but I suspect someone with a better legal background should be consulted. Bottom line, I think there are laws on the books to prevent this guy from doing this and that should be explored.
