1. Jeff Toobin on CNN was saying that the judge won't throw out |
|
the death penalty because too much time and money has been spent by the government on this case. And he was saying that as though it was a perfectly legitimate factor to consider by the judge. I can't believe that an Officer of the Court which Jeffrey Toobin is, sworn to uphold the law and the Constitution would claim that an issue of whether or not justice was done or justice was denied would turn on the amount of money a particular case has cost the government. To me that's an incredible statement.

2. that's a pretty serious "error". basic witness coaching. |
|
i do think the money is "relevant", but i don't see how the government will save money by having to fight and lose the inevitable appeal.
if i were the judge, i'd give the prosecutor the choice between a life sentence or to declare a mistrial and let him try again and get it right this time.

8. too late to "try again" |
|
The witnesses have already been coached. You can't make witnesses forget things they have been told so another trial can be held.

the prosecution could present a case without the tainted witnesses.
i have no idea how seriously that would undermine their case, but it's a possibility.

12. It may have been a good move |
|
by someone who is against the death penalty and used this 'mistake' to squash that option.

4. Judge should declare a mistrial |
|
Moussaoui and company was just following orders from Bush, if they did anything at all. Moussaoui definitely does not deserve the death penalty.

9. It was done intentionally; it was not an accident. |

Witnesses are not allowed to attend trials so that they do not hear the testimony given by others.
These upcoming witnesses were intentionally informed of what had gone on when they were not in the courtroom.
No "goof".
