Ohio House OKs ban on pregnancy disputes

"Ten days after the Ohio Supreme Court ruled that parents of children with birth defects can sue doctors for failing to identify the abnormalities during pregnancy, the House approved a bill that would ban such lawsuits. The bill now goes to Gov. Bob Taft, who is expected to sign it.

The premise of wrongful-birth lawsuits is that parents would have terminated the pregnancies had they been given accurate information about the health of the fetus. The Supreme Court said in a 4-3 decision that parents can sue on such grounds but can collect only the costs of the pregnancy and birth, not the price tag of raising a disabled child.

Republican lawmakers have argued that juries should not be determining the value of a life.

"The premise of this type of lawsuit is that death is preferable to life with a disability. That is unconscionable to me," said Rep. Jim Aslanides, a Coshocton Republican"


Chipping away - pretty hard to prove a doctor withheld the knowledge due to his/her religious issues or was simply incompetent..either was they are now protected.

Have I told you all lately how badly it suck to live in my state? Have I told anyone how far we have fallen? I suppose I don't need to say a word do i?

November 2006 - we TAKE our state back from the frenzied idiots who run it now.

2. I would hope that if this ever happens to a couple or single parent that
they get the home address of the doctor and make SURE to drop it off there...perfectly legal under the Ohio Abandoned Child law as long as it is within a set time frame....no recrimnations to the parent(s) either.

3. In some cases, an ultrasound tech may be the one
writing a report for the doctor to confirm or contest. In those cases, one might be able to prove piety got in the way of medical ethics.

Ultrasounds aren't perfect, though, and some defects may be hidden because of the position of the fetus.

No one is guaranteed a safe pregnancy and childbirth and a perfect child. The sooner we recognize this and start to deal with the reality of the situation and the very real risks involved in bringing children into the world, the sooner we'll start to have more rational policies covering reproductive ethics. In any case, the woman involved in the process should have the option of deciding whether or not to proceed, and she should have as much information as the doc can provide every step of the way.
