WASHINGTON - The National Security Agency could have legally monitored ordinarily confidential communications between doctors and patients or attorneys and their clients, the Justice Department said Friday of its controversial warrantless surveillance program....

Since the program was disclosed in December, some skeptical lawmakers have investigated the Bush administration's legal footing, raising questions including whether the program could capture doctor-patient and attorney-client communications. Such communications normally receive special legal protections.

"Although the program does not specifically target the communications of attorneys or physicians, calls involving such persons would not be categorically excluded from interception," the department said.

The department said the same general criteria for the surveillance program would also apply to doctors' and lawyers' calls: one party must be outside the United States and there must be reason to believe one party is linked to al-Qaida. The department's written response also said that these communications aren't specifically targeted and safeguards are in place to protect privacy rights....

Senate hearing set on move to censure Bush

WASHINGTON (Reuters) - The Republican-led U.S. Senate Judiciary Committee announced on Friday it would hold a hearing next week on a call by a Democratic lawmaker to censure President George W. Bush for his domestic spy program.

In a one-sentence notice, the panel said the hearing would be held next Friday by the order of its chairman, Republican Sen. Arlen Specter (news, bio, voting record) of Pennsylvania, who has opposed censure.

Democratic Sen. Russ Feingold (news, bio, voting record) of Wisconsin introduced a resolution last week calling for a Senate censure of the president, charging that Bush's warrantless domestic surveillance program was illegal. Revelation of the once-secret program has triggered a political uproar.

"Some Democrats in Congress have decided the president is the enemy and the terrorist surveillance program is grounds for censuring the president," Vice President Dick Cheney told a Republican fund-raiser in Orlando, Florida, on Friday, adding, "The American people have already made their decision. They agree with the president.".......

13. they believe the gop spin that the spying
is limited to communications with suspected alqeada members. However that isn't the case - there is no caveat - only trigger is that the communication is with someone outside of the country - though Cheney told us that it wasn't likely that they would be interested in our conversation with Aunt Millie in France. Sorta admits that we just have to trust them that it is only about suspected alqeada.

38. Cheney said something very close to those words
just after the story broke. Something along the lines that we wouldn't be much interested in.... (not that it was not allowed in the program to ...) The door is WIDE open.
