Revised military conduct code puts brothels off-limits

A recent change to the Uniform Code of Military Justice (UCMJ) prohibits military personnel from patronizing a prostitute, even if prostitution has been deemed legal by local civil laws, like brothels in Churchill County.

President George W. Bush amended Article 134 of the UCMJ by Executive Order 12473 last October.

... If a sailor is caught frequenting a Northern Nevada brothel, Upham said the punishment would vary depending upon the circumstances.

"It could include going to a captain's mast or a court martial and can include loss of pay, a reduction in rank or incarceration, depending on the situation."

1. Now that's a way to save money!
Docking military pay in order to line the pockets of military
contractors, BushCo, and CheneyCo...

... a few pennies at a time.

Plus, if a soldier, sailor, or airman is court martialed,
benefits disappear.

9. Any money docked from a military member's pay
due to disciplinary action is given to Armed Forces Homes; establishments designed to take care of veterans in their older years. A military retiree will give up his/her retirement check (or part thereof) for the services provided by the Homes.

Makes you wonder why they didn't just say "if you don't tell us you were off in a cat house, we won't ask you" like they did when they went on gay pecker patrol.

7. I know in Vietnam we had race problems and other problems
ONLY when town was off-limits. As long as everybody was getting laid, there was no problems please were happy...

10. I like to know how they're planning to enforce this in Europe.
On any given weekend a fair share of the NATO forces are in A'dam enjoying its pleasures and I don't mean boat trips around the canals.

The Catch-All Clause.


Anything that doesn't have a specific rule against it comes under Article 134. The rationale behind it is "We say you shouldn't have done that (whatever the alleged infraction may be) and you should have known better. You are WRONG."

It ain't the enforcement..... it's the mindset of the dweebs in charge. I can't fathom soldiers/sailors/Marines doing without sex completely.

17. Article 134 covers debt
Elements.

(1) That the accused was indebted to a certain person or entity in a certain sum;

(2) That this debt became due and payable on or about a certain date;

(3) That while the debt was still due and payable the accused dishonorably failed to pay this debt; and

(4) That, under the circumstances, the conduct of the accused was to the prejudice of good order and discipline in the armed forces or was of a nature to bring discredit upon the armed forces.

Explanation. More than negligence in nonpayment is necessary. The failure to pay must be characterized by deceit, evasion, false promises, or other distinctly culpable circumstances indicating a deliberate nonpayment or grossly indifferent attitude to-ward one’s just obligations. For a debt to form the basis of this offense, the accused must not have had a defense, or an equivalent offset or counterclaim, either in fact or according to the accused’s belief, at the time alleged. The offense should not be charged if there was a genuine dispute between the parties as to the facts or law relating to the debt which would affect the obligation of the accused to pay. The offense is not committed if the creditor or creditors involved are satisfied with the conduct of the debtor with respect to payment. The length of the period of nonpayment and any denial of indebtedness which the accused may have made may tend to prove that the accused’s conduct was dishonorable, but the court-martial may convict only if it finds from all of the evidence that the conduct was in fact
