WASHINGTON - U.S. Capitol Police on Monday asked a federal prosecutor to approve an arrest warrant for Rep. Cynthia McKinney after she tangled with a uniformed officer last week.

"We are working with Capitol Hill police to fully understand and appreciate the incident," principal assistant U.S. Attorney Channing Phillips told The Associated Press in a telephone interview.

Citing the ongoing investigation, Phillips declined to say whether the referral included a recommended charge against the six-term Democrat or when a warrant for her arrest might be issued.

In a statement, Capitol Police said it "has referred its investigative findings to the U.S. attorney." The department must acquire approval from U.S. Attorney Kenneth L. Wainstein before it can ask a judge to issue an arrest warrant on assault or other charges.

The Union (Fraternal Order of the Police) is backing him bigtime.
I wish I knew if they had seen the video. I fear they must have to make such a broad statement.

"There was no excessive force here," said Lou Cannon, president of the Washington, D.C., chapter of the Fraternal Order of Police, which represents Capitol officers. "If she's trying to turn this into a racial issue, people should ask, 'Why is she doing this?' This is an insult to all police officers."

The FOP's national board, meeting Friday in Nashville, unanimously approved a motion commending the Capitol Hill officer, who has not been identified, and condemning McKinney, who was stopped because the officer didn't recognize her.

The charges, if they are filed against her, could include felony assault on a police officer or simple assault, which is a misdemeanor. Before police can make an arrest, the U.S. Attorney's office has to approve the warrant and then notify the U.S. Justice Department because the warrant involves a sitting member of Congress.

U.S. Capitol Police said there is surveillance video of the confrontation between the officer and McKinney, but they say the video will not be released. McKinney released a statement saying she deeply regrets the incident, but was rushing to a meeting when the officer failed to recognize her. "Unfortunately, the Police Officer did not recognize me as a Member of Congress and a confrontation ensued," the statement read.

The rules say she must wear her congressional pin and id. She admitted that she did not have it on. That being the case she should have at least had the common sense or courtesy to stop and check with the security officer before barging on through. Had she done that she would have had no problem what so ever.

The capital police are there to protect both sides and the least she could do is show them some common courtesy.

the police sent info of the incident to the US attorney as is the regular procedure - but supposedly the officer in question said he doesn't wish to press assault charges.

I have no idea of the validity of that information. Just relating what was on our local Atlanta news.
