Police Seek Charge Against McKinney
Congresswoman May Be Prosecuted in Scuffle With Officer

U.S. Capitol Police asked federal prosecutors yesterday to charge Rep. Cynthia McKinney with simple assault in an altercation between the congresswoman and an officer at a security checkpoint last week, police sources said.

Capitol Police issued a statement yesterday saying that they had referred investigators' findings to the U.S. attorney's office in Washington. Police Chief Terrance W. Gainer declined to discuss the matter, referring questions to prosecutors.

Prosecutors must approve the charges sought by police before a warrant can be issued.

Channing Phillips, a spokesman for the U.S. attorney's office, confirmed that police presented the matter to prosecutors yesterday. He said no decision has been made about whether to move forward with charges and gave no timetable for any such action."

..the US attorney's office was not yet decided whether or not to prosecute...My guess is thay don't want to come within a million miles of this case...

11. Maybe if she shot someone she could be as good a rep
as Cheney is for the Republicans. She could have said "Go fuck yourself" for extra measure.

US Congressmen, who shall not be impeded in any way in the performance of their duties. This is in the US Constitution. I am willing to bet the DA will refuse to prosecute.

Even if they had a case, the fact that they are going for the misdemeanor tells me they are going to refuse to prosecute... again that gray line... and you can bet a review in procedures and protocols is right now underway.

By the way... given that they are recommending charging... under ANY OTH#R circumstance nobody should be defending her... and on this one... well it is time people realize that at times a little humility and an apology would have gone a long way. That does not mean that the cop behaved appropriately, fine file a civilian complaint.
