Alexandria, Va. - Secretary of State Condoleezza Rice leaked national defense information to a pro-Israel lobbyist in the same manner that landed a lower-level Pentagon official a 12-year prison sentence, the lobbyist's lawyer said Friday.

Prosecutors Disputed the Claim

The allegations against Rice came as a federal judge granted a defense request to issue subpoenas sought by the defense for Rice and three other government officials in the trial of Steven Rosen and Keith Weissman. The two are former lobbyists with the American Israel Public Affairs Committee who are charged with receiving and disclosing national defense information.

Defense lawyers are asking a judge to dismiss the charges because, among other things, they believe it seeks to criminalize the type of backchannel exchanges between government officials, lobbyists and the press that are part and parcel of how Washington works.

During Friday's hearing, U.S. District Judge T.S. Ellis III said he is considering dismissing the government's entire case because the law used to prosecute Rosen and Weissman may be unconstitutionally vague and broad and infringe on freedom of speech.

The timing of the news release is a bit awkward.

But if they can make the charges stick, I hope Condi gets nailed to the wall.

Your favorite Frat Boy and mine will come to Condi's rescue by confessing that he secretly declassified the document before she gave it to the people at AIPAC, making the matter a little misunderstanding and we should all just forget it. After all, it may be irregular, but if the Frat Boy does it, it isn't illegal.

Condi then throws her arms around the Frat Boy and breathlessly exclaims, "My hero!" The Frat Boy sweeps her off her feet and carries off to the next power conference in a lovely Caribbean Island, where they also visit their money.

Of course, everybody knows Condi and the Frat Boy are lovers. Why? Because they are always lying together.

7. I'll bet they'll throw the whole case out now,
against Rosen and Weissman...meanwhile, Franklin rots in prison. If their case is tossed, he'll probably get out, too.

How convenient for Ms. Rice that this comes out late on a Friday evening.

Abbe Lowell is an attorney for the lobbyists, and he's no dummy!

"Each of these individuals have real-life dealings with the defendants in this case. They'll explain what they told Dr. Rosen in detail," Lowell said. "On day one, Secretary of State Rice tells him certain info and on day two one of the conspirators tells him the same thing or something less volatile."

The indictment against Rosen and Weissman alleges that three government officials leaked sensitive and sometimes classified national defense information to the two, who subsequently revealed what they learned to the press and to an Israeli government official.

Lowell said it is impossible for Rosen and Weissman to determine what is sensitive national defense information when they are receiving the information from government officials who presumably understand national security law and therefore would not improperly disclose national defense information.


Check out the Newsweek story. It's SOP for the judge to say he's taking it under consideration. That has nothing to do with what his decision will be!

12. Sorry to be so cynical, but Jack Rabbit's scenario above,
seems pretty likely, to me. And with all this drumming up for action now against Iran, they'll play it as "necessary leaking", just as they've done with all the Iraq crap that the prez is now getting away with. Rice will never be forced to give any testimony, that lawyer will use it to get his clients off, the media will say someone is "playing politics" in the entire case, and Homeland Security will do another showy round-up of undocumented peoples, to take our minds off it all.

I do feel Ethel and Julius Rosenberg rolling in their graves, tho.

17. Time will tell. I'll be watching as I'm sure you will be.
I see a very BIG dark cloud hanging over the WH, and it's been there since hmmmm, February or so. There's no wind, so it's not moving, just hanging there and dumping er....sh**!

The Pentagon Spy case, imo, is even worse than the Plame affair. I happen to think that Rosen and Weissman are probably telling the truth when they claim they were not spying, because they didn't need to.

They claim the information was freely given to them by government officials. The information was then passed on to an Israeli diplomat (who fled the country, btw).

Since Condy and Feith, Ledeen, Cheney, Wolfowitz et al were desperate to push the agenda of the PNAC, they were in contact with members of AIPAC (Rosen and Weissman were AIPAC members). None of these people had the interests of the US in mind, imo. Not Condy, Cheney or any of them. They had their own agenda, and from what I've read of the FBI investigation so far, treason was committed by several top US officials.

Why this case was taken off the news, is a mystery ~ I think it is one of the biggest stories involving this administration so far. Larry Franklin will be going to jail. He is talking to the prosecution. But AIPAC has distanced itself from Rosen and Weissman, which angered the two, naturally.

I hope this case does not get thrown out of court ~ all this involves the same criminals who started the Iraq war based on lies, and if I recall, ties into the Forged Niger documents case also.

15. This is a big story that got swept under the rug, maybe it's Condi's time
to be the next "Hardball case", with recent Rove indict mention, the timing for Condi news piece is excellant.

Strategic Military/Intelligence Leaks: Part of either disinformation campaign or allegiance. This is seen as legal as long as it does not put into peril our own security. An example of this would be those planted stories by military agents (disinformation) or leaks of tactical information to foreign agents we may be using in the field, an example may be MEK (allegiance).

Industrial Military/Intelligence Leaks - 'Enabled': this is what I describe as a leak that happens from the contractors end, with the blessing and/or support of certain people in the military/DOD structure for their own interests, but is in fact illegal and does in fact compromise our national security. An example of this would be what Sibel uncovered.

Industrial Military/Intelligence Leaks - 'Solo': same as above, but done without the approval/blessing of any insider. Stealing secrets from military/DOD to essentially make money. A good example of this is the codes Chalabi got a hold of and sold to Iran.

Nationalistic/Ideological Military/Intelligence Leaks: This would be where an agent of another country infiltrates our own military/intelligence infrastructure. A spy essentially or mole. Larry Franklin case might fall here, as he was not acting as a mercenary.

Political Military/Intelligence Leaks: Leaks that are politically motivated, that is not to say that there cannot be multiple reasons, such as "enabled" but the public best knows these cases as 'political hits' - the outing of Valerie Plame is the best example.

The Pentagon Spy case was about the ideology of the PNACers who intended to restructure the entire ME. Iran was the focus of those accused in this case, as I recall.

Following the case, I recall that this case crossed over to the meeting in Rome re the Niger Forgeries. We all connected that meeting to the Iraq pre-war intelligence case ~ but I believe Larisa pointed out that it was more about Iran than Iraq.

Larry Franklin attended that meeting, along with Ledeen (who is still pushing war with Iran) and at least one Iran arms dealer.

I'm trying to recall some of what I read about the Pentagon Spy case and it seems to me that some of the 'work' that was going on was forged documents making their way to Iran, which would 'prove' that Iran had the means to build nuclear weapons.

Top government officials, like Condy, Cheney, Wolfowitz, Ledeen, Feith et al were all involved in this case. I remember right after the guilty plea entered by Larry Franklin, Judy Miller received the letter from Libby releasing her to name him as her source. 'The Aspens will be turning' he wrote.

If Weissman and Rosen are telling the truth, all those involved in the Plame leak, the false intel. that led to the Iraq war, are facing charges of treason. Giving classified information to a foreign government IS treasonous.

AIPAC wanted Rosen and Weissman to settle, enter a plea to avoid this trial, which they feared (along with the rest of the PNACers) would or could expose their treasonous part in the Larry Franklin has said he was guilty of.

i think we can definitely rule out 3 & 5, and probably #1.

however, i'm not sure if we know that condi's leak was along the samelines franklin's leak - or if it was unrelated.

sibel seems quite familiar with the aipac case - so perhaps there's an element of Leak Type #2
sibel: "the AIPAC spy scandal, as far as I'm reading today, is just touching the surface of it. It's going only to a certain degree. It doesn't go high enough, in what it involves and how far it goes, and that's... as far as I can explain."
