MONTGOMERY | The National Labor Relations Board might make a federal case out of a proposed state constitutional amendment that would guarantee a secret-ballot election when employees are choosing whether to unionize.
The proposed amendment, passed by the Legislature this spring, will be on the general election ballot in 2012. The amendment would preclude using the card check method to organize a union.
But the NLRB has already filed suit in federal court to block a similar amendment passed by Arizona voters last year and has threatened to sue other states that have passed amendments prohibiting card check. The board contends that the amendments conflict with federal labor law.
Rep. Kurt Wallace, R-Maplesville, who sponsored Alabama's amendment, expects the NLRB to sue if voters approve the measure, but said he believes it will survive the challenge. "We're just going to see how it does," he said Thursday.
