1. Official White House Doctrine
Edited on Sun Jan-31-10 03:19 PM by 90-percent
This whole aroma of "Let's give them a fair trial and then hang 'em" Wild West Justice they are predicting seems downright Un-american to me.

Didn't we once have "The Constitution" that stated the principals our Founding Fathers were striving for when they created this Country of Hope and Vision for a better life for all humanity?

We are no longer an "Innocent until proven guilty Country". We want to administer justice they way terrorists tried to do to us on September 11, 2001.

I'm not particularly proud of being an American born citizen of a Country that practices principals indistinguishable from Khalid Sheikh Mohammed himself? Shouldn't there be a good guy and bad guy here? Instead of a Middle eastern Badguy and the shining beacon of might makes right Badguy of American Anti-terrorism Doctrine?

-90% Jimmy

Taxation without Representation
Guilty without a trial
Corporate Fascism
Wars based on lies
Murder of tens of thousands (100,000 to 1,000,000 Iraqi dead, as estimated by everybody. All estimates fall in the stated range)
No Public Option because 60 to 80% of all Americans favor some form of it
Military industrial Complex
More mercs than Enlisted serving in both our wars. Serviceman pulls down $20,000 a year and the merc gets $100,000 a year, plus the merc does not have to answer to anybody but their employer. They are above the law and cannot be held to account for murder or various other heinous war crimes.
Bank and Wall street bailouts
Legal framework for totalitarianism becoming more firmly established.
Record Concentration of wealth
Refusal to address structural economic problems
Legal to knowingly lie on TV news.
Major media spouting dog whistles for racism
Hate media
Supreme Court Ruling of January 21, 2010

2. "innocent until proven guilty" is a jury instruction
Edited on Sun Jan-31-10 05:06 PM by jberryhill
...to remind them of the burden of proof.

This may come as a surprise to you, but the prosecution - ie the DOJ - is not required to consider anyone to be innocent. If they did, we would not have trials, now would we.

9. It doesn't matter

Anyone is perfectly entitled to their opinion about the guilt or innocence of a criminal defendant. Last I heard, the president appointed the Attorney General.

It's not as if the verdict in, say, the murder of Dr. Tiller was any great surprise.

10. Rubbish logical dissonance at its finest, me things.

So Gibbs, who is not a member of the DOJ, can proclaim publicly the guilt of a defendant on an ongoing trial because the DOJ has a duty to prosecute criminals. LOL, that makes perfect sense then.

11. Yeah... The executive branch does that sort of thing...

But you are confusing two things.

First, people tend to recite "innocent until proven guilty" as if it were some sort of universal commandment, instead of a rule of presumptions afforded
in the course of court proceedings. The most obvious point there is that if it were, then there would be no criminal prosecutions.

Second, and more broadly, anyone outside of a court proceeding - including members of the executive branch, or just plain old citizens, is entitled to opine on the subject. Clearly the president believes there is enough admissible evidence to obtain a conviction.

The reaction of some to trying terrorists is like the bedwetting here at DU over Dr. Tiller's murderer being entitled to put on a defense at his trial. The outcome is pretty much a foregone conclusion, but the nervous nellies who do no think our system works need a reminder now and then, and that's pretty much the angle the administration is taking here.
