This story was posted on DU back in 2007 when the lawsuit began.

Heidi Zamecnik and Alexander Nuxoll sued Neuqua Valley High School (Naperville, Ill.) sued the school after administrators made Heidi block out "not gay" from her "be happy, not gay" T-shirt during the "Day of Silence". The US Court of Appeals for the 7th Circuit ruled in favor of the students under 1st Amendment grounds. Both Ana and Cenk defended the shirt as a free speech issue but not ideologically. (And I know Naperville as the hometown of Super Bowl-winning New Orleans Saints coach Sean Payton.)

Bottom line is, free speech is for EVERYONE, even bigots; that's why the Supreme Court ruled that the Westboro Baptist Church couldn't be sued for picketing a military funeral.

2. It makes a lot of sense for schools to not

allow any writing or graphics or pictures on t-shirts that students wear. Period. Okay, so maybe the little name of supposedly upscale shirts, but nothing else. That way no one needs to decide what's acceptable and what isn't.

3. 1st Amendment Rights?

The clown who is interviewed in that video talks about 1st Amendments right. Obviously he does not know that a state also has police power which allows it to regulate certain conduct in order to promote public safety. Therefore, the school board acting on behalf of the state can determine that such a t shirt may provoke danger. As such it may force anyone to refrain from wearing one.
