This is getting tiring. Can't Congress just put all of these a**holes in shackles and start getting to the bottom of these things? Why on earth do we ever let the President appoint the person who is responsible for prosecuting him?

1. Mukasey clearly has a conflict of interest.
He represents the White House which apparently holds that if the White House or the higher echelons of the CIA OK'd the torture/destruction of the evidence regarding the torture, then no crime was committed. So, Mukasey's presumption in ordering the "investigation" seems to be that there is nothing to investigate because no crime was committed if the parties had "authorization," whatever that means to perform the act or acts that they performed. In adopting that presumption, Mukasey exercised his judgment which is biased by the fact that he is beholden to the President for his position and serves at the will of the White House (which is used in this post to mean also high echelons of the intelligence or military community). Obviously, the authorization would have come from the White House or the agents of the White House. So Mukasey's presumption that "authorization" by the White House means no crime was committed makes the results of his investigation a foregone conclusion. Mukasey is saying that he will not investigate whether it was wrong for the White House to authorize the conduct. I disagree with Mukasey's presumption. If the White House authorized torture in violation of international and U.S. law, if the White House authorized the destruction of the tapes in violation of U.S. law, then Mukasey must investigate the wrongdoing of the White House and prosecute his own boss.

If Mukasey is unwilling or unable to investigate the President or the White House or their agents, it is time for the Senate to take this matter into its own hands and pass a special counsel statute that permits an investigation into this matter. If the Senate does not do that, we will know that our senators are not serious about defending the Constitution or ending torture. There isn't much we can do about it other than to turn of the TV and shut off the media that is deafening and blinding Americans to the theft of democracy by powerful interests.

2. Mukasey has lain the pavement for impeachment to proceed.

Noone left to investigate Bush except Congress, that's obvious now.

And certainly no one in the House other than Kucinich will try to do so.
