http://www.ajc.com/news/content/metro/stories/2007/06/12/0612wilson.htmlGenarlow Wilson, sentenced to 10 years in prison for receiving consensual oral sex in 2003 from a 15-year-old girl when he was 17, is facing what will likely be a months-long battle in the Georgia Supreme Court to have his conviction thrown out, his attorney said today.
"Normally an appeal takes months," B.J. Bernstein said. "Even at an expedited level it is still going to take a while."
Meanwhile, Bernstein is seeking to get Wilson released on bond from prison pending the appeal. Douglas County District Attorney David McDade, whose office prosecuted Wilson, has so far refused to consent to a bond, Berstein said.
Douglas County Superior Court Judge David T. Emerson will make a bond ruling based on several criteria, including Wilson's risk of fleeing and his ties to the community, Bernstein said.
"None of those should be issues," Bernstein said. "He was out on bond before. He has always attended court like he was supposed to. He has no prior record."
"I want him out," Bernstein added. "It's time. Enough already."
