The special prosecutor in the CIA leak case is urging a federal judge to put former White House aide Lewis Libby in prison right away.

In court documents filed today, Patrick Fitzgerald says an appeals court is unlikely to overturn Libby's conviction because the evidence against him is so overwhelming.

Jurors found that Libby lied to investigators -- about how he learned that Valerie Plame worked for the CIA, and also about the people with whom he shared that information.

Libby has argued that he has a good chance of winning an appeal and should be allowed to remain free until that challenge has run its course.

The judge who sentenced Libby to two-and-a-half years in prison has said he sees no reason to grant Libby's request. He's scheduled a hearing for Thursday.

Gee. It has to be that way, or the prosecutor's work is in vain. The defense and the WH gamed the case already in order to shake the noose.

Jail the perp so he will talk. It's the fair thing to do.

10. I'm not so sure he will be pardoned. For one thing, a pardon means that he no

longer has 5th amendment protection against self-incrimination. Congress will likely call him to testify under oath on the Plame case, and he will not be able to claim this protection, and if he lies again, under these circumstances, back to the slammer he could go.

That's a dicey one for Bush and especially for Cheney.

You might say they will bribe Libby, or have bribed him--with future goodies (a life of luxurious leisure in, oh, Dubai?)--but I doubt he would want to go through another trial like this one, and imperil his freedom again. So the pull on him to testify truthfully would be great as well.

But they might wait until Jan. '09 to pardon him, when they can all go to Dubai together for luxurious retirement. That would skim a half a year off his 2 year+ sentence, and he won't ever have to do his 400 hours community service. (That's the part I want to see!). But they haven't made a good case for a pardon. Judge Walton has not made it easy, in that respect. They don't have a "soft" judge. (Did you see his reply to Bork & Co.? It was hilarious, and the sharpest rebuke I've ever read from a judge to "luminary" powers-that-be (his word).) Also, it is by no means clear that Karl Rove wants Libby pardoned. (Libby tried to leave Rove holding the bag--they had a big fight about it.) And Karl Rove seems to still be in charge. The split seems to be Bush/Rove on one side, Cheney/Libby on the other. The domestic looters vs. the foreign policy looters. The domestic looters still in the White House, still in power, whereas the foreign policy looters are on the outs (Libby convicted; Rumsfeld ousted; Cheney rather isolated).

Libby has always acted "the good soldier," and may endure jail, for 1 1/2 years, to protect Cheney (thus avoiding getting into Congress' sights)--thence to the Dubai permanent holiday. In any case, I don't think this is an easy one for the White House, CURRENTLY, and I am certain that they do NOT want the Plame case investigated any further. I think it has many a hidden land mine in it, for the Bushites, way beyond what is already known.
