Scooter's Sentence
I suppose I should be pleased about the tough sentence handed down by Judge Reggie Walton, sentencing the vice president's former Chief of Staff Scooter Libby to serve 30 months in prison. After all, he's a Republican, and I'm a Democrat; I'm an opponent of the war, and he worked for one of its architects. I'm certainly no fan of his boss, Dick Cheney, one of the toughest hardball players to occupy the office of vice president. Former Ambassador Joe Wilson was practically gloating this morning when asked to comment on the sentence, declaring it a victory for the rule of law.

Maybe.

Having taught law for more years than I want to count anymore, and criminal law in particular, I know all the arguments about how the rule of law depends on everyone telling the truth, cooperating with criminal investigations, not trying to protect their bosses or those around them. I understand that people in high places have as much responsibility, or more, than the rest of us to follow the law and give their evidence, and that when they don't, their years of public service are no excuse.

Being chief of staff for the vice president is a bruising job, but also an exciting one. If Scooter Libby hadn't messed up, he'd be sitting pretty in a high-priced law firm right now, making a fortune not because his legal skills were better than anyone else's, but because his contacts and connections were. So with the good goes the bad; with the visibility goes the scrutiny; with the fame comes the price. Valerie Plame's career has been ruined. Why shouldn't his be?

The only problem here is that there was no underlying crime. The answer to the question Special Prosecutor Patrick Fitzgerald was initially appointed to investigate — had anyone violated the law in disclosing Ms. Plame's name in their effort to discredit her husband's criticism of the administration's war policy — was no. No one violated what we used to call the "Agents Law." Dick Armitage, the guy who admits he gave out her name in the first place, isn't facing time; nor are Karl Rove, Dick Cheney, or any of the reporters or news organizations who didn't hesitate to disclose her identity.

how the hell is it that she can't figure out that perjury and obstruction of justice are, themselves, crimes? There doesn't have to be an "underlying crime"; if you lie under oath that IS the crime. You can lie to a grand jury or during a deposition ABOUT something that isn't a crime (i.e., getting a blowjob from an intern), but the lie itself is still a crime -- just ask all the ranting idiots who were after Clinton's ass about said blowjob, who claimed it was the perjury that warranted impeachment.

And, as Fitzgerald explained in the first place, Scooter's lies also constituted obstruction of justice because it prevented them from getting enough information about the alleged underlying crime to prosecute anybody for it. That's why they call it obstruction of justice, for god's sake! Duh!

What the hell is wrong with her? Can they disbar somebody for being dumb as a bag of hammers?

choose to pour out their sympathies--not on the underpriveleged, not on the oppressed, not on the lowly soldiers who die doing their bidding, not on the sick who can't afford doctors, not on working joes just scraping by. No, on SCOOTER LIBBY. A priveleged, powerful man who, because of his own actions, was convicted of a crime by a jury of his peers. What stunted and twisted hearts, if they have them at all.

"The rule of law depends on everyone telling the truth." Libby lied, and that is the crime he is going to prison for. All he had to do was tell the truth.....but he chose otherwise, and is now suffering the consequences.

What part of that does she not understand. Clinton was impeached for lying about a blowjob. Libby lied about the outing of a CIA agent to investigators. He is not above the law. Either he tells the truth, or he goes to prison. He was well aware of that fact before he testified. He CHOSE to go to prison, plain and simple! Dumb choice, eh?

Susan Estrich is one of those "Dems" like Bob Shrum or the DLC leadership that is far more interested in sucking up to their Beltway crowd and getting face time on Fox News than they are in fighting for justice. It's a closed and narrow class thing; there are too many to name like this, but try David Broder, Tim Russert and Joe Klein as three more smug practitioners who are completely out of touch. It's up to us to stop this crew; don't look for help from the likes of Susan Estrich.

And Joe Wilson remains a hero of mine.

Ya know, the funny thing about this case, it is bringing out the true colors of many of those supposedly on our side. No crime. Poor scooter.
