Investigation Uncovers ‘Extensive Destruction’ Of RNC Emails, Violations Of Records Act

House investigators have learned that the Bush administration’s use of Republican National Committee email accounts is far greater than previously disclosed — 140,216 emails sent or received by Karl Rove alone — and that the RNC has overseen “extensive destruction” of many of the emails, including all email records for 51 White House officials.

For the last several months, the House Oversight and Government Reform Committee has been “investigating whether White House officials violated the Presidential Records Act” by using email accounts maintained by the RNC and the Bush-Cheney ‘04 campaign for official White House communications. Today’s findings confirm that the accounts were used “for official purposes, such as communicating with federal agencies about federal appointments and policies.” The report adds:

Given the heavy reliance by White House officials on RNC e-mail accounts, the high rank of the White House officials involved, and the large quantity of missing e-mails, the potential violation of the Presidential Records Act may be extensive.

Some other key findings:

– RNC account use far greater than believed: Despite White House spokesperson Dana Perino’s claim that 50 White House officials used RNC email accounts “over the course of the administration,” the committee learned that at least 88 White House officials had RNC e-mail accounts.

– Bush-Cheney 04 campaign stonewalling: The committee says it may need to “issue compulsory process” to force the cooperation of the Bush-Cheney ‘04 campaign. Despite providing at least eleven White House officials with email accounts, “the campaign has unjustifiably refused” to provide the Committee with even the most basic information about the accounts, including the number of e-mails that have been preserved.

– Destroyed RNC emails may be preserved by federal agencies. The RNC has preserved only 130 e-mails sent to Karl Rove during Bush’s first term and no e-mails sent by Rove prior to November 2003. “For many other White House officials, the RNC has no e-mails from before the fall of 2006.” Thankfully, several federal agencies contacted by the committee “may have preserved official communications that were destroyed by the RNC.”

The Use of RNC E-Mail Accounts by White House Officials

The Oversight Committee has been investigating whether White House officials violated the Presidential Records Act by using e-mail accounts maintained by the Republican National Committee and the Bush Cheney ‘04 campaign for official White House communications. This interim staff report provides a summary of the evidence the Committee has received to date, along with recommendations for next steps in the investigation.

The information the Committee has received in the investigation reveals:

The number of White House officials given RNC e-mail accounts is higher than previously disclosed.
In March 2007, White House spokesperson Dana Perino said that only a “handful of officials” had RNC e-mail accounts. In later statements, her estimate rose to “50 over the course of the administration.” In fact, the Committee has learned from the RNC that at least 88 White House officials had RNC e-mail accounts. The officials with RNC e-mail accounts include Karl Rove, the President’s senior advisor; Andrew Card, the former White House Chief of Staff; Ken Mehlman, the former White House Director of Political Affairs; and many other officials in the Office of Political Affairs, the Office of Communications, and the Office of the Vice President.

White House officials made extensive use of their RNC e-mail accounts.
The RNC has preserved 140,216 e-mails sent or received by Karl Rove. Over half of these e-mails (75,374) were sent to or received from individuals using official “.gov” e-mail accounts. Other heavy users of RNC e-mail accounts include former White House Director of Political Affairs Sara Taylor (66,018 e-mails) and Deputy Director of Political Affairs Scott Jennings (35,198 e-mails). These e-mail accounts were used by White House officials for official purposes, such as communicating with federal agencies about federal appointments and policies.

There has been extensive destruction of the e-mails of White House officials by the RNC.
Of the 88 White House officials who received RNC e-mail accounts, the RNC has preserved no e-mails for 51 officials. In a deposition, Susan Ralston, Mr. Rove’s former executive assistant, testified that many of the White House officials for whom the RNC has no e-mail records were regular users of their RNC e-mail accounts. Although the RNC has preserved no e-mail records for Ken Mehlman, the former Director of Political Affairs, Ms. Ralston testified that Mr. Mehlman used his account “frequently, daily.” In addition, there are major gaps in the e-mail records of the 37 White House officials for whom the RNC did preserve e-mails. The RNC has preserved only 130 e-mails sent to Mr. Rove during President Bush’s first term and no e-mails sent by Mr. Rove prior to November 2003. For many other White House officials, the RNC has no e-mails from before the fall of 2006.

I want impeachment too. But at this point, I'll take what I can get. If all that happens is that the bastards resign in shame then at least they will be gone. More than anything, I just want them to leave office.

Keep in mind all the hearings and incriminating evidence that has come out since chairmen like Waxman, Conyers and Leahy have had the helm. It's been only six months since we took the house and senate. I think thing are going along quite nicely.

IF there were active operations to destroy and delete emails AFTER the RNC knew or should have known that preservation was required to comply with legitimate requests of Congress, then those involved need to go to prison. period.

AS Fitzgerald pointed out in the Libby trial, lying and obstruction of justice robs us of the truth and those acts should be punished severely.

It has been reported today that Virginia Republican Party Chairman Ed Gillespie will abandon his post before today's primary elections conclude in order to join George Bush's White House. The Washington lobbyist who talked so boldly just last week about hitting a "grand slam" in Virginia is now calling in a pinch hitter.


THE FACTS: Gillespie Leaves RPV in Disarray

Gillespie Fails to Unite Party and Stand Up to Partisan Extreme. Gillespie's failure to unite Republicans has created a Republican primary season marked by in-fighting. Instead of talking about the issues and their vision for Virginia, Republican incumbents have been forced to defend themselves from friendly-fire and charges of being a "'RINO,' or ‘Republican in name only.'" One conservative candidate has called the primaries a "battle for the heart and soul of the Republican Party." The result of this infighting? Republicans lack momentum heading into November.

Gillespie's Tenure Marked by Possible Scandal. Observers of Virginia politics know that Republicans are beating back at least two possible scandals in the state. The first is in the 27th Senate District, where the Republican's own Mark Tate has raised questions into whether or not Gillespie orchestrated the use of secret Grand Jury testimony for partisan purposes. It's a matter that veteran RPV official Jim Rich (10th District Chairman) has said "needs to be looked into." The second growing controversy involves Republican Attorney General Bob McDonnell, who was blasted by two editorials this weekend for failing to avoid the appearance of impropriety regarding investigations in his office.

Gillespie Raised Money Has Put Candidates in Compromising Position. While Gillespie is reported to have infused the Party with Bush money last month, he has put his candidates in the awkward position of having to accept money from an unpopular president. For example, will Sen. Ken Cuccinelli take Party/Bush money, even though Cuccinelli said he no longer considers Bush the leader of the Republican party? Will Del. Jeff Frederick, who said Bush is "dragging us down" and "crazy" on the issue of immigration, accept Gillespie's money?

As usual I will role my eyes SIGH and say "Yeah I've knew about that over a year ago"

130 emails the first four years huh? If that doesn't send up redflags nothing will. It is going to be a shame to watch them get taken down by techonology....okay it won't be a shame it will be really sweet though.

The White House has a number of servers, some official, and others not.

Official e-mail servers were always backed up by off-site systems kept by an agency of the US military. The other messages going in and out of the White House went through proprietary and commercial systems that are not protected by the same sort of safeguards designed to keep official White House communications secure and confidential.

NSA may have a record of the RNC and GWB43 e-mails. Unlike the official system, there are no special legal and procedural protections that would require NSA to safeguard that data.

We know that Scooter used a secure White House line to talk to Judy Miller about Valerie Plame on at least one occasion. I think neither we nor White House officials involved in that crime should assume that the NSA another Agency would be compelled to withhold surviving record of such conversations from investigators, especially since the Intel Community has an institutional interest in seeing the case successfully prosecuted.

Yesterday, I posted on CREW's revelation that there were as many as five million emails missing from the White House's system. These were emails totally separate from the emails on RNC-issued email accounts. They were in the White House system.

Today, during the White House press gaggle, Dana Perino gave an explanation of sorts:

But there was a conversion sometime between 2002 and 2003 to convert people that were using Lotus Notes when we first arrived to Microsoft Outlook. And I know that the tech people worked to get us all transferred over. We had to save our Word documents and all to make sure that they weren't lost in that transition.

I don't have a specific number for you. Again, I wouldn't rule out that there were a potential 5 million emails lost, but we'll see if we can get to you. If it was 5 million, I think that, again, out of 1,700 people using email every day, again, there was no intent to have lost them.

Also, long distance companies like that patriotic supporter of spying on customers AT&T? Or Verizon? Those electrons traveled over a large distance - they were trapped somewhere. If the RNC won't produce them, surely there are tape or CD backups in Iron Mountain or some such place. At least the most recent ones should be available.

I also would like to know what charges will be brought & what potential penalties? And I agree there should be a special prosecutor. If the Dems had to pursue every lead for all the malfeasance of this corrupt administration they'd never be able to do anything else.

Today I've read about old diabetic men being Tasered in their beds; grandmothers shot to death while sitting in their kitchens; children being tortured, raped and murdered in Abu Ghraib; and numerous other atrocities that are apparently ok with the majority of folks in the United States, including Congress.

Isn't it time to arrest some people in the White House? If one can be Tasered in one's bed for calling 911, shouldn't one be arrested for destroying evidence?

Back during the Clinton impeachment fiasco, the Republicans, and my formerly somewhat-reasonable Republican Congresswoman, chanted "Rule of Law, "Rule of Law" as justification enough to pursue what everybody admitted to be mostly foolish charges against Clinton.

So it is maddeningly amusing to listen to these same Republicans work to trivialize the many violations of law by this administration. Ain't hypocrisy great?

To delete an email after you read it and dump your deleted folder.
That I'd understand to a degree. But destruction of email is also
a complex task if it goes beyond that. As Sen. Pat Lahey pointed
out...you can't tell me there isn't some record in some server.
Email goes through many computers on its way, stuff can really
be traced if you want to find it, or destroy it. If they are
able to just show a concerted, extreme effort to delete just
certain emails establishing a pattern, it can be enough of a
guilty behavior to be effective. Maybe not to impeach or put
Rove behind bars where he belongs, but it could put an aire
of distrust over the GOP. We need that as much as possible.
As sure as Nixon hurt them without impeachment, this can...

say to America - a Gulliani or Thompson administration is a
clear endorsement of 'more of the same'. More covert action
and underhandedness. Do you really want that? That'd work...
