Anyone ever been asked to leave a bar by a bouncer?
Edited on Tue Sep-18-07 07:56 PM by Harper_is_Bush
This idea that people have absolute freedom of movement and speech on PRIVATE PROPERTY is false.

The little trouble-maker was asked essentially by the OWNERS of the property to leave.

When he refused, he was taken by the arms and guided to comply with the request.

When he resisted and strugled, HE was escalating it.

I've seen trouble-makers in the bar during my wasted youth who were approached by bouncers and told they needed to leave. When they refused, they were man-handled much more forcebly than that guy. Bouncers are essentially acting on behalf of the OWNERS of the bar, which is PRIVATE PROPERTY. They have a right to do what they do. These university police were no different.

There's a lot of melo-drama and outrage over the treatment this kid got...and false claims that it's an assault on free speech...but in the end it boild down to this:

He was asked to leave and he refused and then physically resisted when being made to leave.

He got what he asked for.

EDIT: Before responding to me, make sure to check out the police report:
http://i.a.cnn.net/cnn/2007/images/09/18/offense.report.072274.pdf
As Senator Kerry was ending his speech, a man disrupted the senator by screaming, yelling,
and flailing his arms. The man moved his way down the aisle yelling, "Why don't you answer
my questions, I have been waiting and listening to you speak in circles for the last two hours."
"These officers are going to arrest me". I didn't see any officer directly next to him until I
noticed Officer Wise walking down trying to get his attention. The man was screaming and
yelling obscenities until Senator Kerry told him to calm down and that he would take his
question, but he needed to calm down. At that point, the man stated, "You will take my
question because I have been listening to your crap for two hours"
. The man at that point
turned to his friend and said, "Are you taping this? Do you have this? You ready?" The man
was talking to a woman who was there to film him.
Before asking the question, I had a chance
to ask the man if he was a student and he stated, "I don't have to tell you." I the asked him if
he knew the rules to the student code of conduct and he said, "What?" I informed the man
that after he asked Senator Kerry the question that I needed to talk to him outside. After
asking the question, the man would not let Senator Kerry finish his statement and kept
badgering the senator about his beliefs, talking about "blow jobs", and yelling as loud as he
could as to sensationalize his presence.

At that moment the Accent Director, Max Tyroler, asked us to take him out of the auditorium
and had his microphone turned off stating, "He had said enough." Officer Wise and I
grabbed both of the man's arms and asked him to come with us out of the auditorium to
speak with us. The man then lifted me up and pushed Officer Wise to avoid being taken into
custody. As he pushed and kicked Officer Wise,....

You can read the rest here...

Quite obviously a planned stunt by a troubled and naive young man. He's learned a lesson about the world I hope....he is not the center of it..and even in a free society you cannot do whatever you want.

1. He swung at a cop.
Clipped him on the chin with his right fist.

He got off easy.

'nuff said.

15. Yep. Where I live, making contact with a cop's body parts lands
you not just in jail, but sent away for a few months. I was wondering if he was "off his meds" when I heard him.

Sounds to me like the whole thing was staged to get on film, and the cops "fell for it" and this guy ends up looking like the victim. Of course, we do have a developing problem with freedom of speech and intolerance in this country when a person can't wear a Peace t-shirt to a speech (code pink).

21. If you read the police report (see OP for link) in it's entirety it's quite obvious..
..he knew EXACTLY what he was up to.

When the cameras weren't present, he settled down. When cameras returned, he ramped up.

In the police car he was relaxed and in a good mood, and even asked if there would be cameras at the police station.

He's an ego-centric publicity seeking whore, nothing more.

5. No, not "apples and oranges" at all. The analogy is sound...
it's private property, and when asked to leave, if you don't comply, you can be removed by fource.

If you have someone in your home who will not leave you are permitted to do the same.

If you have a political event in your home and you ask someone to leave and they will not, you may use force.

4. Exactly. In fact, if anyone's freedom of speech was being violated, it was Kerry's and the audience'
Meyer first barged in ahead of line, in front of other students who wanted to ask Kerry questions. Then, when Kerry tried to answer Meyer's questions, Meyer wouldn't let him.

I would never get away with this kind of shit...which is why I can't imagine anyone either defending or accepting this kind of behavior. It seems to be all the rage now...the world is full of Bill O'Reilly bullies, but hey..it's free speech. Who cares if a free-for-all takes place in a school auditorium, and some get hurt? It's free speech. Why not give the kid a gun, then he could really get his point across. Wouldn't that be fun?

It was the students holding the talk who asked police to escort him out. If he had just done what they asked none of this would have happened.

If it had been me, I would have listened to the police and followed their instructions. Based on what we are hearing about this kid, he is clearly the type who likes to cause problems.

I will complement him for asking interesting questions though.

This disruptor is lucky tasered is all he got.

I have no sympathy. He was violent and combative, and the taser didn't kill him.

But it did give him something to cry about, and rightly so.

Is Kerry supposed to interfere with the police while they attempt to get a violent disruptor under control? Yeah, "Super Kerry" should step in and save the AGGRESSOR from the police. (?!?!?)

My god, I am stunned that anybody thinks that screaming profanities and pushing and shoving cops is acceptable.

The fact that this wack-job was yelling about that D&D fantasy "Skull and Bones" voo-doo magic crap further demonstrates that he's a delusional conspiracy theorist and a schizo to boot.

Valid questions are one thing, but obscenity laced rants about black magic and blow-jobs are the behaviors of a bat-shit crazy lunatic.

I also had a friend who was arrested for "trespass after warning" for returning to a club the same evening he was asked to leave...

Your post is essentially correct except for one small point...He was on public property but you can be asked to leave public property as well if you are disruptive... I'm a big Miami Heat fan and I have seen Jimmy Buffett and the city manager of I believe Miami thrown out of the arena for being disruptive...They had front row seats and were actively heckling and distracting the referees...

In fact you are told before the game if you are being "disruptive" you can be asked to leave...

30. I think the problem people are having with this is the blurry line of "excessive force".
I think this is why there is so much "confusion".

It's the tazer. It's the tackling.

The "victim" may indeed have brought this on himself. And the tazer is supposedly to make the officer's job easier and or safer.

I've been trying to decide if these cases in the last few days justified the force. And I can see it's not exactly a cut and dry issue.

Or having George Bush investigate himself.

Or the media asking the public to be believe it just one more time.

If authority has no credibility it has no one to blame but itself.

A democracy should require a vote of no confidence when its government's credibility is gone.

So Faux News has the right to ask a guest to leave a program if they do that, too, wouldn't they?

And call the cops if the guest sits there and continues to talk?

Well, OK, they'd just cut it off the air. But that's the same idea.

I'm skipping most of the other threads on this topic. The "kid" set this all up and was rude to the audience members who wanted access to Senator Kerry. He marketed himself as free speech good guy and so many people fell for it. It was a stunt and the jackass is getting too much airplay as it is.

I guess all the campus police could have dragged him down to the ground then hogged tied him and carried him out. Of course if he kicked or injured some sitting guest, or well too bad for them. I personally have no problem how the university police handled the guy. I'm just happy no one in audience was injured. I personally care more about them then the stunt man.

43. Police officers are not bouncers.
They have the power to arrest, and therefore a much greater obligation to justice.

A political forum on a University campus is not a bar. It is a place where the free and open discussion of ideas should be fostered.

University students are not bar patrons. They have an expectation of protection and respect on campus, as precedent from a multitude of wrongful death and harassment lawsuits can attest to.
