of Bush, Cheney & co., who lied to him (according to him) about whether Libby and Rove were involved. Happens every day in that cauldron of corruption, Wash DC. That's what McClellan was hired to do--lie! He's NOT saying they lied to Fitzgerald, FBI or grand jury (unless I'm misunderstanding this)--which WOULD be a crime. If McClellan lied to Fitz/FBI/GJ, that's another story--but McClellan wouldn't be disclosing it now. Fitz GJ is still possible. So if McClellan talked to Fitz/FBI/GJ, Fitz knew that Bush/Cheney & co. lied to McClellan, and McClellan lied to the public. And if McClellan talk to Fitz et al, he probably should have.
It could be sort of a contributing factor to the main conspiracy, but standing alone, is not a crime and is a conspiracy to commit a crime. Again, they lied to the PUBLIC--to the press--not to legal authorities. It's a scandal, but a crime.
Fitzgerald extensively interviewed lots of people, including Libby and Rove. So HE knew they were involved--but criminally involved?, or lying to him?, were the questions. The outing statute requires knowledge and I think malice, or something like that. Very hard to prosecute. So Rove wormed his way out of it, and Libby lied--and is covering for Cheney (who was clearly a Fitz target). Anyway, if there was a crime in anyone lying to the PUBLIC about Libby and Rove being involved, Fitz would have gone after them. Unfortunately, it isn't really a crime. Impeachable, but not criminal. (You can be impeached for being unfit for duty, not fulfilling your duties, pervasive lying to the public, and a lot of things that are not crimes--but probably it would take actual crimes to get the 2/3 vote in the Senate.)
And you can be sure that I want to see all of them behind bars for the rest of their lives (or better, life sentences of cleaning bedpans in veterans' hospitals). I'm not trying to excuse mass murderers, torturers, master thieves and shredders of our Constitution. Just looking at this particular thing from a legal viewpoint. Not a lawyer here, but some legal experience and study.
