Radio Host Sues Group That Quoted Him

Monday, December 3, 2007

SAN FRANCISCO - A conservative radio talk show host sued an Islamic civil rights group on Monday for copyright infringement over the organization's use of a portion of his show in which he called the Quran a "book of hate."

Michael Savage said the Washington, D.C.-based Council on American-Islamic Relations, or CAIR, violated his rights by wrongfully using a 4-minute segment of his Oct. 29 "The Savage Nation" show in a letter-writing campaign directed against talk radio advertisers. Audio from the show remained on CAIR's Web site Monday.

In the broadcast, Savage called the Muslim holy book "a throwback document" and a "book of hate."

"What kind of religion is this? What kind of world are you living in when you let them in here with that throwback document in their hand, which is a book of hate," Savage said during the portion of the broadcast highlighted by CAIR. "Don't tell me I need reeducation. They need deportation."

In an interview with The Associated Press on Monday, Savage said he was talking about Iran president Mahmoud Ahmadinejad and his dangerous and violent brand of Islamic extremism, not about the religion in general.

Savage said he strongly supports freedom of speech, but "it's another thing to take away a man's millstone and try to put him out of business." ......(more)

1. he suing for copy write infringement, if his case isn't thrown out it will be an interesting
one to watch.

He's such a D*uchebag, every time i drive to SF i see that billboard with his big ugly mug on it, it's pollution imo.

6. i bet he wanted to sue for libel but his lawyer said no.
so he's doing the proverbial "throw enough shit against a wall and something will stick" type of thing hence the copy write infringement bullshit.

9. Seems pretty obvious to me
Unless he can prove that his bigoted statements are original works that need to be protected.

I'm guessing that he won't want to hear them quoted back to a courtroom about 500 times, so he'll probably just slink off back to his slimy hole in the ground.

Trouble here is what exactly IS fair use?

It would be nice if it were defined (like, you can't use more than 30 seconds), but it isn't.

DJs across the country have gotten in trouble for using the tiniest clips from songs.

I would think it's fair use, but Savage is going to claim they were rebroadcasting his show.

Sigwart, who founded TBTM along with her husband Michael Stinson, aka "Symbolman," and Don Waller, aka "The American Stranger," points out that Savage has actually made it a point to threaten his critics with lawsuits and other harassment. On his radio show he called the defendants, GLAAD and other critics of his show "stinking rats" who "hide in sewers."

Savage said: "You live by handouts, all of you. You live off grants, all of you. You're a bunch of beggars... If you continue this, we're going to go after your funding sources. And we will do everything we can within the legal realm to cut off that funding. We are also going to go to the Justice Department under John Ashcroft."

The defendants say that the lawsuit doesn't make sense on a logical level for several reasons -- it names Sigwart individually, even though TBTM is a corporation and anything on the site is put there in the name of the corporation. The TBTM item in question is no longer on the site and was only there for a brief time to begin with.

"We took it off because we didn't think it was newsworthy anymore; Michael Savage is nothing to us," said Stinson.

Leavitt says that rather than defaming Savage, as he is accused of doing, he is merely quoting him. "He's the one that is defaming himself, and he's the one responsible for losing his own advertisers," he s

We're going to contact our lawyer, he's got the goods on this guy and can probably share it with these folks, this is just another SLAAP suit, designed to Quell freedom of speech and Savage is an asshole..

He's using the EXACT statement he made with us about the "millstone around his neck" .. The only millstone NEAR his neck is his Hateful, brainless HEAD :)

He'll drop this, but not til his lawyers have intimidated these people and cost them a LOT of money...

Sure looks like someone should sue him for his constant abridgement through litigation of MANY groups rights to free speech...

11. I was proud back then to recommend a law firm with a large 1st Amendment practice AND offices in Chi
Jenner and Block.

With offices in Chicago. That was important at the time.

And a number of cases heard by the SCOTUS every year.

I was gonna PM you, but then I remembered the Hawaii time thing.

12. Which is why we should spend all of a filing fee to mass sue him.
Those of us who have the $65 to $125 available could file pro se complaints against him (service is only $15 or so via the sheriff's office).

That would be so much fun to spend down a power-freak.

Just a thought. Well, actually, I've had thoughts like this about wearing down other power-freaks, too.
