Antonin Scalia is the fascist Justice who personally shut down the state-wide recount in Florida on December 10, 2000 when he issued an emergency injunction in Bush v. Gore saying an accurate recount would hurt George W. Bush. Scalia's unprecedented injuction created a furor among law school professors, and 673 signed a letter of outrage that was published in major newspapers. Two days later, Scalia was one of five partisan Republicans who threw out 175,000 never-counted Florida votes so they could declare George Bush the winner. When those votes were finally counted, Gore won Florida under all 6 scenarios in which all of the votes were counted.

4. What do you suggest? Al Gore fought for over 30 days in 2000 and then conceded

once the USSC ruled by one-vote against him. Impeach Scalia? That would be nice, but I don't see anybody advocating this. If you're going to impeach Scalia then you have to impeach the other four (we'll O'Connor is already gone) who voted with him.

But if Gore had found a way to trigger a statewide recount of all disputed ballots, or if the courts had required it, the result likely would have been different. An examination of uncounted ballots throughout Florida found enough where voter intent was clear to give Gore the narrowest of margins.

Bush would have widened his 537-vote victory to a 1,665-vote margin if the recount ordered by the Florida Supreme Court would have been allowed to continue, using standards that would have allowed even faintly dimpled "undervotes" -- ballots the voter has noticeably indented but had not punched all the way through -- to be counted.

The study, conducted by the accounting firm of BDO Seidman, counted over 60,000 votes in Florida's 67 counties, tabulating separate vote totals in several standards categories.

While the USA Today report focused on what would have happened had the Florida Supreme Court-ordered recount not been halted by the U.S. Supreme Court, the Herald pointed to one scenario under which Gore could have scored a narrow victory -- a fresh recount in all counties using the most generous standards.

8. I recall back then even some hard line Dems didn't want Gore to fight it, I did and many an argument

ensued, I was accused of simply being ignorant on how politics work, they have since changed their minds, and I was very ignorant back then, more so then now concering politics but even I knew he should have fought it all the way but sadly not enough people backed him and he knew it which is why he threw in the towel.

He seems to have moved on from 2000.

I remember how Nixon believed that the 1960 election was stolen by the Daley/mob machine for Kennedy. Nixon spent the next few years building back his base and power and won what he thought was his rightful place in the White House in '68. Many think that his paranoia over the '60 election fueled the dirty tricks of the 72 campaign even though he seemed to have no chance of losing. The things he did to Muskie are legend, and of course he beat McGovern in a landside.

If Gore and Kerry were fighting back like Nixon I might give more thought to worrying about it. Meanwhile there are more important things to work on.
