fox broadcasting caught "dognapping" during football game


"Sweetney blogger Tracey Gaughran-Perez and her husband were surprised to see a photo of their dog, Truman, appear in Fox's "Happy Holiday" ticker during a football game. According to Gaughran-Perez, someone from Fox yanked a photo (far left) of Truman in a Santa suit from her blog or Flickr stream, Photoshopped in a hat, and inserted the image (left) into their holiday promotion graphic rotation. Gaughgran-Perez is quite peeved. Truman couldn't be reached for comment. From Gaughran-Perez's post on the matter:

publicly? if you don't want it stolen, try not putting it up on the internet. it's fair game, as far as I know.

6. Actually, it's not fair game when used for commercial purposes.
The person who takes the photo holds copyright.

Yep, they owe her some bucks now. If it were my my rates would have just doubled or tripled.

as no harm, financial or otherwise, was done to the owner of the copyrighted photo.

But honestly, I have little sympathy for anyone who posts a photo online and then complains when it gets pilfered. if it gets on the internet, you need to watermark that or kiss it bye-bye.

14. As much as I dislike Faux, I don't think that these people have a case
There are some clear and distinct differences between the two pictures. The shape of the front paw, the shape of the dog's mouth. I think that these are simply two very similar pictures, that's all.
