Very exciting towards the end of the day with three notes from the jury that Walton won't release until 9:30 AM. Looks like we may have counts on which the jury has found guilt.

I can't find any discussion any more today anywhere else and I am getting so excited.

3. We've been down this road before and have been disappointed
so I think some of us are wary of getting all excited about a jury decision.

It's too bad but I'm tired of feeling jacked around. I want a good, hard decision. I am still hopeful that there will be a good decision.

5. That's what they said on FDL too. Apparently something gave them the idea that the jury has
already agreed Libby lied, and the discussion is now wether they have to agree he lied on both dates or only one. The last thing they have to decide is Count 3 (Cooper).

I'd sayif not tomorrow, the latest I'd expect is Wed. for sure.

9. That is where I have been on and off all day...
But no more discussion today.

I just have waited so so long.

I am too nervous and excited thinking about the things that will follow.

7. What I'm hoping for is for Waxmen to start a investigation
into just WHY she was outed. That's the big offense here, not the fact that Libby lied when asked about it. This is what has pissed me off about Fitzgerald.

19. If it says Libby, Libby, Libby on the label, label, label, you will like it,
like it, like it on your table, table, table...

Somehow I don't think that jingle could've considered 'on the table for dissection'.

14. Both sides preparing to present answer to jury question re their
request to see and use Grand Jury testimony. Doesn't mean a verdict. Don't know why there is not already a guilty. hmmmmmmmf

18. Actually I think it is this...
snip

It was my impression in the courtroom (and MSNBC confirms, based on courthouse sources) that there are three new separate questions, all about Count 3, the Cooper false statement charge.

At one point, I believe Walton said (and others who heard it confirm that this was their impression as well) that the jury has reached a unanimous decision regarding the fact that Libby lied.* Walton had issued some instruction, however, that they need to decide that he lied on October 14th and November 26th dates (both FBI interviews), but now says he should have used the word "or" instead of "and" — i.e., if the jury all agrees that Libby lied on either of these dates, they have reached a unanimous guilty verdict. (The indictment itself says "and.")

However, there seems to be some confusion — do they all agree on one date, or do some agree on one and not the other? Thus the defense and prosecution are arguing about language to use before they present it to the judge.

snip

I watched Scooter throughout the proceeding. No smiles now. He seems to have moved off into appeal land. Mrs. Libby was not in the courtroom, but was standing outside the overflow courtroom when we came out into the hall.

the Grand Jury testimony.
