Once he's sentenced, in June, he'll file an appeal, and file a motion asking the judge to let him stay out on bail while the appeal winds its way through the system (which will take years.) Usually, the judge will only grant the bail motion if he thinks the appeal has a decent chance of succeeding. If not, as Martha Stewart found out, he'll rule that Libby will have to do the appeal from behind bars, and order him to report to prison in a matter of days.

17. You're right -- I misspoke. But definitely until sentencing.

It would be very unusual for a person convicted of a white-collar crime not to be granted bail, at least until sentencing. What happens after sentencing but before appeal (or new trial motions) remains to be seen.

Judge Reggie M. Walton, who presided over the four weeks of testimony and presentation of evidence, set sentencing for June 5. Under complicated sentencing guidelines that are no longer mandatory, Judge Walton has wide discretion in setting a jail term.

But lawyers not involved in the case, who are experienced in the issue of sentencing, calculated that under the guidelines, Mr. Libby might be sentenced to 20 to 27 months.

8. That's up to the judge. He's not in jail right now, but when Wells files the appeal

the judge will determine if Libby gets to say out of prison while awaiting the appeal results. As I understand it, if the judge doesn't feel there will be much of a chance for Libby to WIN on appeal, he could well deny his ability to stay a free man, and would be carted off that day.

16. When and if Libby goes to jail it will be in one of the Repub's

minimum security resorts, and he will serve no more than one year to fifteen months at that. Once Bush pardons him Christmas day, 2008, Cheney will have a nice six figure job lined up for him with either Halliburton or one of his buddy's other corporate entities. Libby will not suffer, you can be sure of that.
