Tancredo's July FEC report. (Issues)

The first July FEC report is in and there are already issues. According to Tancredo's June report he had $0 debt and $27,558.54 in "Operating Expenses." According to his July filing he has $0 debt and $26,762.09 in "Operating Expenses."

I might be jumping the gun, but it appears to me with his $0 debt and only a $796.45 difference in "Operating Expenses" he his using his remaining $221,637.72 in Public Funding for his personal expenses until the convention instead of returning it and filing a Termination Report like he agreed to when he entered into the Public Funding program.

Is this legal?
