Does anyone know if when Bu$h leaves office
and has not been impeached, can he be investigated, indicted and tried?
Or does he fall under a protection of the actions of a head of state?

3. He can still be impeached.
And it would be easier to try him and jail him. It is in the constitution. Someone posted it but I can't remember where or when.

4. I don't think that once he has left office
he can be impeached. But if Congress does not grow a spine and impeach him now, can he be arrested for war crimes, crimes against peace, crimes against the constitution, etc. in or by the US (the ICC may probably do something) and under US law can he claim immunity due to his former status as head of state?

8. Impeached
Once he leaves office, he cannot be impeached and tried. The sole punishment authorized in the constitution for being found guilty at the Senate trial, is removal from office. Once removed from office he "shall nevertheless be liable and subject to Indictment, Trial Judgment, and Punishment according to the Law" (Art. I section 3) of the Constitution.

6. I am all but certain that once out of office
he can be indicted like any other criminal. That was Nixon's obsession after August 9th 1974, and supposedly why Ford pardoned him.

He must be impeached and convicted first but afterwards he is not immune to any actions he took as President. If he leaves office without being impeached he can just be prosecuted.
