I don't like the idea of him walking at all, but I have to wonder if it is the right thing to not give him an out if we could, like you say, protect the innocent more. I would really like to see him spend the rest of his days living in shame like Richard Nixon did. No, wait. Bush deserves far more shame than Nixon. I haven't seen anything like a victory over the Dictator's regime. He has just upped the number of troops in his big "surge" from 21,500 to 25,000 and added another billion dollars to the "surge's" price tag. He has purged the Justice Department's lawyers and thumbed his nose at the congress. Where is this "victory" you talk about?
