But key new details are also included. Perhaps the most important of which is this: the Patriot Act provision allowing the Attorney General to appoint US Attorneys by fiat was at the heart of this. The Post quotes an email from the now resigned Sampson in which he tells Miers: "I am only in favor of executing on a plan to push some USAs out if we really are ready and willing to put in the time necessary to select candidates and get them appointed. It will be counterproductive to DOJ operations if we push USAs out and then don't have replacements ready to roll immediately. I strongly recommend that as a matter of administration, we utilize the new statutory provisions that authorize the AG to make USA appointments. we can give far less deference to home state senators and thereby get 1.) our preferred person appointed and 2.) do it far faster and more efficiently at less political costs to the White House."

Harriet Miers, President Bush's failed Supreme Court nominee, has submitted her resignation as White House counsel, the White House announced Thursday.
White House press secretary Tony Snow said the president reluctantly accepted her resignation, which takes effect Jan. 31. He said a search for a successor is under way.

Miers was nominated in October 2005 by President Bush to replace retiring Justice Sandra Day O'Connor, but she dropped out under fire from conservatives who questioned her qualifications and would not support her.

Asked why she was leaving, Snow said: "Basically, she has been here six years."

Critics questioned her experience, her judicial beliefs and her grasp of constitutional law.

Now, preparing to leave the White House more than a year after the ordeal, Miers says she doesn't regret the experience. After being nominated, she heard from childhood friends. Strangers came up to her to say they were happy for her.

But here's something not open for debate: the old gal loves exclamation points and seemed to enjoy writing gushy notes to then-Governor George W. Bush. Below you'll find copies of personal correspondence exchanged between Bush and Miers from 1995-2000 (before migrating to Washington, Miers headed the Texas State Lottery Commission, a post to which Bush appointed her). The Bush-Miers letters were among more than 2000 pages of documents released this week by the Texas State Library and Archives Commission. In a 1997 Hallmark greeting card (adorned with a photo of a dog), Miers sent along belated birthday wishes and noted that "You are the best governor ever--deserving of great respect!" In another note (penned on an American Greetings card), Miers wrote that she hoped Bush's daughters realized that their parents were "cool." A 1995 Miers note thanked Bush for a visit, adding that an airplane ride with the governor was "Cool!" "Two staffers said they saw the Senator wearing 'tartan' or 'buffalo plaid' pajama bottoms and a 'loose-fitting shirt.' By the end of the day, one informant called to say she heard Domenici was walking around in his boxers."

But Domenici told Roll Call the pajama bottoms were actually hunting pants.

Kudos to TPM for its execellent coverage on this "non-story". When I heard Joe "Kool-Aid" DeGenova complain, you know you've hit a real nerve this regime won't be able to dance away from so easily.

The question Josh has asked that is the elephant in the room is how many cases were expidited...how many other USAs were forced out for partisan reasons and who inside the White House was calling the shots (like we don't know coughrovecough). Turdblossom's up to his bald little head in this and it's not just Domenici that should go down, but a whole bunch of other Repugnicans...including Heather Wilson and Doc Hastings.

As detailed in other threads, Sampson, while Gonzo's #1 assistant and while being the gatekeeper for applications for USA positions, was pushing to get HIMSELF appointed as the USA to Utah. He was blocked by Orin Hatch, i.e., a home state senator, who had promised the slot to one of his Judiciary staffers. The struggle went on for four months, but Hatch eventually won, and Sampson did NOT get the appointment.

And Sampson has such an ego and such a basic contempt for the rule of law, and the responsibility of the USAs, that he had the gall to push himself forward for this position without ANY prosecutorial experience. That's the equivalent of putting a fine arts major in charge of an engineering company, or electing as judge a lawyer who has never tried a case.

....which despite everything, would still surprise me unless he is looking
a sure-fire indictment straight in the face, Bill Richardson, the popular
Democratic Governor of New Mexico, and, by the way a candidate for the
presidential nomination in 2008, will surely nominate a replacement of
the utmost integrity as a contrast. I doubt the Republican Party in New
Mexico has a person of any prominence that fits this bill. This is reason
enough for Richardson to nominate a Democrat to fill Domenici's term. This
is also reason enough for Rove to lean on Domenici to stay on until the bombs
are penetrating the bunker, so to speak.

Rove and Cheney are betting that despite all their obvious sleaze and circumventing
of our Constitution, that they can hold on until January 20, 2009. On this day,
they will instruct Boy George to issue the necessary pardons before leaving office,
and they can all charter their very own 787 to Dubai and live happily ever after.

Or something.

But don't look for the rats to desert the ship unless the water is seeping into the
deckhouse. If Gonzales is impeached, there still won't be enough Republican votes
to remove him in the Senate unless criminal indictments have been issued, and seeing
as how he is AG, there are plenty of obstacles that can be tossed into that path.

If a few smoking guns can be produced, THEN Slimeballs like Gonzales and Domenici
will have cause to worry about surviving in office beyond the summer. Otherwise,
they will all take a lesson from the Richard Nixon book of questionable tactics
and stonewall, stonewall, stonewall. And don't look for any honorable conservatives
on the Republican side to come forward and demand resignations from the obviously
guilty.
